Malpractice claims are almost always going to be controlled by state substantive law. Google "Maryland informed consent law" for Maryland law which differs from many other states.

Yes, you have three years to bring a civil claim. Realistically, you are not going to bring a civil claim for the destruction of a cell phone. The juice is not worth the squeeze.

You have asked this question under the medical malpractice section. If you are asking whether you have a malpractice claim, the answer would be that we would have no idea without seeing your medical records. But I'm not even sure what the claim would be in this case.

The question is whether she tripped as the result of the negligence of the store? You are not liable just because someone falls in your store.

Q: Is a civil suit an option for me?

I live in an apartment complex. The buildings are poorly numbered and while the mail more often than not makes it here, there are times where my mail is frequently mis-delivered to another Apt. I think for us to answer that question, we would need to see the evidence of the misdelivery. It would also be helpful if you put them on notice of the problem. The bigger question is where are the goods? Where did they go? Can you prove the misdelivery? Where do they say the delivery went?... View More

Q: I'm suppose to be a full time employee at this office. They cut my hours and are giving me 3 hours everyday.

I signed a contract with them for full time. The only reason my hours are getting cut is because I have class everyday so I leave work at 5pm to get to class at 6pm. The office runs from 6am-8pm... Is this legal? Also they knew I was going to school ever since they offered me the job.

Without knowing all of the facts, it is certainly possible. But the damages would most likely be limited to the vet bill you already offer to pay. Tragically, in my opinion, animals are treated like pure property in Maryland. This injustice actually helps you in this case.

If the scratches are preexisting, you would win. But if they are not, your neighbor would have a valid claim against you. I can't see them filing suit as a practical matter but you never can tell. Ethically, if you son's bike caused the damage, you should pay for it.

I think the smart thing is to send them a letter certified mail return receipt requested asking them to pick up the property by some date in the future (the longer the better) and otherwise you are going to give the stuff to Goodwill (or whatever).

Money held in trust for a minor until they reach the age of majority.

The money is really for your child in most cases so you can't use it to buy a home. You could go to a Maryland Circuit Court judge by filing a motion and asking that you be allowed to use that money to buy a home...
