In Minnesota, people with a Minnesota drivers license will face a revocation of their drivers license as a "habitual violator" under the administrative rules for the Minnesota Department of Public Safety if three petty misdemeanor driving convictions within 12 months or 5 within 24 months... The warning was for not having my updated insurance card on my person and to get my speedometer checked. However, today I received a final notice that a speeding ticket was due, but the citation I was given never mentioned a speeding fine, or a court date. I don't have the citation because it... It's difficult to piece together what happened from this description. But it's easy to know how to contest a speeding ticket. Ask court administration for a first appearance court date. Most people want to keep their drivers license record clean. Admitting 59 in a 55 mph zone would... View More

First, I would generally avoid calling to encourage the court or prosecutor to file and prosecute a traffic ticket. But now that it's been filed with the court, it's time to fight it. Whatever is entered into the court's database about it can always be changed later either by the... View More
Driving record with conditions of a fine and one years no tickets but I got on 12/30/2017 and the year will be up in march 03 2018. Should just fight this ticket till the other ticket expires? And the tickets are in two different county's in Minnesota . What should I do?

What to do is up to you. Personally, I make every effort to keep traffic violations off the drivers license record. But if a new one would trigger a prior with a condition of no new traffic violations, I'd try to prevent a conviction on the court record as well. One thing is for sure,... View More

For the woman--it's knocked down to inattentive. For the truck driver? Workers comp, wraparound wage loss, p.i. claim.
Serious enough charge that the woman should consult an attorney, the driver should contact a member of the the Minn. ASn for Justice--they give free consults.
They made me stand in the below zero temperatures for two hours...never asked my side, did not investigate... then said he was citing me and told me to pick it up tomorrow... what can I do?
answered on Dec 23, 2017
He never got your side but you said as a result of what you did there was a wreck, so the problem is?..............sorry to be obtuse but I'm not getting it. See what the citation says. It may be a stop sign violation, it may be something else. If you don't believe you violated the stop... View More
I was pulled over for "failing to yield" the cop gave me a ticket for no drivers license and proof of insurance- i have both just not on me at the time. I asked him if I could go to court and he threatened if i did he would give me a "failed to yield" citation. Can he do that or is it just a threat?

You now know that it's not the best idea to let a police officer know at a traffic stop that you plan to challenge a citation in court. Next time. But, yes, the prosecutor can amend the charge (to add another) while the case is pending in court. I would still challenge it in court... View More
And should one get a citation if he didn't stop when a school bus was stopped before the intersection and the person was on the other road, going perpendicularly to the bus. Should one stop or can he go? I've seen people going, while others stopped. Could one get a citation for not... View More

The Minnesota Statute making it a crime to disregard a school bus stop arm appears to apply to vehicles on the same road as the school bus. See, Minn. Stat. Sec. 169.444

I'd suggest reading the document a police officer gave you. If it directs you to respond in some way, then I'd suggest doing so. What I think of as a written warning from a police officer is not a traffic citation, and so is not a violation charge and will not led to a conviction that... View More
It is her car under her name and all.

There may be a way for a car owner to find out about parking tickets issued to their car, but it would likely require some effort on their part. On the other, an unpaid parking ticket would likely result in mail demanding payment and eventually worse -- making it likely the owner would learn of it.
If I just paid would it go on my driving record ? if it does would it come off when I'm 18? Or would it be better to go to court? I really don't know what to do

If a Minnesota resident and Minnesota licensed driver pays a speeding ticket for 64 in a 55 mph zone, that would be treated under Minnesota Statutes so-called "Dimler Amendment law" so that though the conviction would appear on the court record, it would not appear on the drivers license... :Conviction deemed a Petty Misdemeanor pursuant to Minn. R. Crim. P 23.02. Is it over? What do we expect from here? Will this be on his criminal record?

The term "criminal record" can be misleading, if convenient. There is no one criminal record. Organizations generally keep records of many things. Government agencies do. Many government records are publicly available to anyone. Public government records relating to an individuals... View More
Traffic ticket for speeding the judge found me guilty but not beyond reasonable doubt.
answered on Oct 26, 2017
I believe we already discussed this on the phone so I won't go into detail here. Short answer is "it's possible, but a judge would have to give a specific warning first." I am skeptical that the court would follow through on such an extreme threat.
It's great to... View More

First, a driving offense will not be "certified as a driving-related conviction" by the Minnesota District Court, unless there is a conviction first. A conviction could result either from paying the fine by mail or otherwise, a guilty plea in court, or a guilty verdict after a trial.... View More

I would. It won't change the past, but it might help if he does get a ticket in the mail and then goes to court on it.

I don't know with certainty that all 50 states are now part of the Interstate Compact on Drivers Licenses, but last I checked almost all 50 were. Therefore it is highly likely. Your home state may assign points for out-of-state traffic tickets. The Interstate Compact model statute has... View More
I am in Minnesota. But recently moved from Wisconsin so the address is yet to be updated. Where will I get if I get citation
answered on Oct 12, 2017
Perhaps not. But just in case since you've recently moved to Minnesota it would be a good idea to apply for a Minnesota Drivers License right away. That should improve the chances that if a citation is issued, you'll get it. As you may know, a failure to appear on a citation can... View More

I was going 64 when pulled over. Statute was 169.14.2a3, for passing. I thought I was in a 70 zone, but apparently I was just short of it as the officer pointed out to me and that I was still in a 55 zone. Some ways back was a construction zone which is 55, but because of it there was a barricade... View More
