I would need to know some more information to know if the case was properly brought in whichever state it was filed. You need to make sure that you respond within 30 days (in a number of states, it's 21 days), or ask for leave to file out of time with the court.
That made me uncomfortable for my child. Is there anything they can do to try and take him from me or force shared custody.

It'll be difficult for the court to enforce that the 17-year-old should be going between each parents. However, in an ideal world, the judge would tell the parent who had custody of the child to ensure that they return to the other parent.

You can ask for them to consent to termination which is much simpler. I think that if the parent has been absent for that long, then you have a good case for seeking termination of that parent's rights.

Is there a current custody hearing that is going to take place or are you speaking about one in the future? The petition should be filed in the "home state" of the child.
