Q: My mother is trying to file her taxes. She has filed for divorce due to abuse but the other party will not sign

She has not lived with him for over 3 years, she lives in OK now and I believe he lives in MS. Is she considered legally separated and can she file as single?

If she has not been granted a divorce then she is technically still married therefore she cannot file as single. However she can file married filing separately. You need to contact a family law attorney to help get the divorce finalized.

You need to sit down with a tax attorney and go through this as it is a detailed matter that is beyond the scope of this forum. However, if you are an oklahoma resident this will still be considered income for tax purposes.

Q: If you are making child support payments are they allowed to take your taxes.

I owe back payment but I thought if you made the monthly payment they couldn't take your taxes. They didn't take it last year

Q: I am on a school board for a private school.

Can a parent make a donation to the school (501c3) and then ask for the money back if they move or enroll their child elsewhere?

The parent can ask - but there isn't anything requiring the refund. There is no federal law, and most states classify the donation as a gift and therefore no longer the property of the person giving the donation, and thus not required to be returned. In essence the answer is no, but the Oklahoma Administrative Code 710:65-19-143 does spell it out a little.

In a nut shell, the Native American tribes are considered domestic nations within the US not foreign nations (hence no US embassy). As a result you cannot denounce your US citizenship and expect to be able to remain in the US. This would restrict your business as well, unless you became a citizen... Read more »

In order for the tag/title to be transferred it has to be brought up to current. Whether you pay that fee or the seller is up to you as the purchaser.

Q: My husband is incarcerated and has no earned income, can I file mfj and claim the ctc for our kids based on my income

You would need to have your return reviewed by a Tax law attorney or a Tax Accountant to determine if you did something in error. Short answer, yes you may accept donations without a tax number, because by default your tax number is your social security number that you use on all your tax forms. I’d probably start by contacting the Attorney General’s office - specifically the consumer protection division. It might also be worth filing a police report for fraud and you could have a civil fraud claim against this person as well.

Q: If a company is suspended by the tax commission, can they still do business legally?

It was a tow company that impounded my vehicle due to a traffic stop and me not having proper updated tags; which I also hear that insurance is voluntary unless you’re operating a commercial vehicle. The tow company is currently suspended via the tax commission on the Secretary of State website.

First - insurance is not voluntary, hence the reason it is called compulsory insurance. There is a minimum amount required by law.

Q: My son turned 18 in August . And I want to know if that nullified the child custody plan?

In the Child custody plan my ex is entitled to claim our “minor” child on his taxes, with the proper form. Is this still in affect, now that he is no longer a minor?
