Q: Can I get a traffic ticket if I have already exited and locked a vehicle in a walmart parking lot.

Was told I was wreakless driving only received a ticket for lack of insurance card was told to go back to the car get my registration and insurance card

Yes. The Officer probably claims he observed the driving violations by you prior to parking it. He also confronted you and asked for your Registration and Insurance. Just because he accosted you after the car was parked is irrelevant.

You can refuse to sign acknowledgement of the Summons to Court. But the Officer that stopped you will probably arrest you. It is his discretion. If you do not show up to Court after signing the Ticket or making Bail, the Judge will probably send out a Bench Warrant for your Arrest, possibly... View More

Q: Can a 17 year old plead guilty for a speeding ticket, pay online, and not have to come to court?

I’m wondering if I would still be considered a juvenile and have to come to court for a speeding ticket because I just want to plead guilty and pay online.

That would be a stupid thing to do. At worst the Judge will find you guilty. But appearing in Court might allow the Judge and/or DA to Divert your Case in one of several manners. Q: Is it legal to be searched on a traffic violation?

Was stopped for a traffic violation,the officer took my purse out of my car searched it and my car.

The officer said he found a meth pipe. Went to jail.Chargedwith Drug Para.Did not get a ticket on traffic violation. Is this legal?

If the officer had a legitimate reason to stop you, then yes. Issuing a Citation bolsters the State's assertion of a legal stop, but it is not required for the officer to charge you with every crime he witnesses. Yes if the vehicle was factory equipped to illuminate the Plate. Antique Autos are also exempt.

Yes it is illegal to have a License Plate on a vehicle where the Plate is not Registered to it.

Q: Research for mock trial: is there any law stating one cannot park a vehicle on the side of a highway if it can move?

In my case, the defendant hit a motorbike supposedly parked on the side of a highway or going very slowly in the middle of the highway based on various sources. Is there a law stating that the motorcyclist should not of been parked there in the first place?

Q: Can I get out of a careless/reckless ticket for falling asleep if I am diagnosed with sleep apnea after the accident?

I was driving a commercial vehicle, struck a guardrail and debris struck another vehicle but there were no injuries.

Possible. You can raise it as a defense. However that may have other implications. I'd suggest you discuss it with an attorney who handles tickets and points issues in the county where it happened. As you may have a CDL,worth paying for a consult.

Q: Just got pulled over in Dyersburg but they never gave me a reason to why they pulled me over. But got a ticket for no dl

I was doing the speed limit n didn't change lanes but as soon as they saw me pass they pulled me over for no reason. My plates are still good and have insurance just wondering if I can fight this in court?

Sure you could choose to fight it in court. To stop you, the police must have probable cause. If they did not have probable cause to stop you, any violation found after the stop may be inadmissible.

Yes, T. C. A. § 39-17-1307 was amended in July of 2017 to allow for the possession of a handgun in a vehicle. The usual restrictions still apply. i.e. no felon in possession, must be in lawful possession of car, etc.

Possibly. You may want to have an attorney or at least consult one so your rates don't go up. If you were hurt you may have an uninsured motorist claim and would be well advised to consult a member of the Tenn Assn for Justice--they give free consults.

Look at TCA 40-35-111. TCA 55-8-136 states a violation is a class C misdeamenor.

Q: I was given a speeding ticket. When I arrived to the given court date, my name was not on the docket. What should I do?

I was given a second court dat but my name wasn’t on the docket this time either. 18 months later, I received a “failure to appear” letter. At this point I have lost the ticket.

Going to driving school may impact your ticket. But it doesn't impact who is at fault in the accident- unless you were found guilty. Then it might be admissible as to fault. I am assuming you pled not guilty and received diversion if you attended driving school.

You should contact the Department of Safety and Homeland Security. They can tell you why your license is suspended. It usually has to do with tickets that were not paid and can be resolved.
