There is no law that would prohibit you from driving in a sling. The only thing that would matter is that you are able to fully and safely operate the vehicle you were driving.

Q: Will my now 17 year old daughter lose her license for being at fault in a failure to yield accident?

The accident happened 2 1/2 weeks before her birthday. She was waiting to turn left in the center lane into a store. Traffic the opposite direction was either at a red light or one that had just turned green. A woman had stopped to wave her through. Apparently neither saw the car in the other lane.... View More

If she was waived through she can claim she was yielding but other driver indicated by the wave that no traffic to yield to, plead not guilty.

Can she go to traffic school? Usually can for first time.

Before arguing she needs to drive to get to school, look at alternates.

If you weren't charged with reckless driving then consider yourself lucky. Consult local counsel for your best options. An attorney can review the ticket and determine your best course of action.

If you didn't get a ticket you should not get any points. But if you had an "at fault" accident your insurance company may raise rates or could cancel your insurance. I am not saying they will - it is a possibility. Also, make sure you turn in the form to the state showing proof... View More

Q: my brakes gave out and I hit a guard rail. Wasn't speeding and no other cars involved. Got ticketed for Due Care?

I totaled my car on a highway going the speed limit. I went in for a turn onto an on-ramp but my brakes gave out. No way of knowing it would happen. I maintained as much control as possible and even purposefully avoided a car, and then straight into the guard rail.

The phrase "not complying" is too generic to tell what happened.

In a nutshell, once pulled over, you are required to give your name and address. That is it.

But, if you did not follow orders of police, for getting out of the car, or physically resisted them, when the...

Complying with an officer's request is almost always the best response. Your question does not explain why you are reluctant to allow the officer to take possession of the license - again, if he is going to write a ticket/citation, he will want the license to get i.d. information and after... You need to be sure to retain an attorney ASAP and/or appear (if necessary) at the court date and contest the ticket. If you just pay the ticket, it will be considered a guilty plea and you will receive all related points on your driving record.
