Q: Me and my boyfriend are both miners and I accidentally got bleach on him and his mother is trying to press charges .

He is find and there was no body or physically harm was done .would I still get jail time?

what were his injuries?

did you pour on him or throw at him?

if no record and not serious injuries a good lawyer can handle without jail time.

DV does not have to draw blood or be black and blue..........a shove is DV............though maybe it shouldn't be

for a minor it will be a violation of the welfare and institution code in that on X day the minor did ........................

Misdemeanor domestic violence conviction (non-sexual) was in 2003. No temporary or permanent protection order was requested nor obtained from spouse. more info is needed.

it sounds like you or someone else called the police to report you for DV on your boyfriend and a "keep away" order was issued.

did you get notice of a TRO (restraining order)?

you need a lawyer to appear and remove the ordered

i assume you are suggesting you called police on her and now want to drop charges.

that happens on at least 1/3 of all DV cases. The spouse is afraid it will put husband in jail and he won't be able to pay for home, food, kids etc

R u saying there was a TRO without a criminal filing?

i would not think old DV would be filed upon ......if so you would argue Serna arguments that there was a lack of due process in that you didn't receive a speedy trial and can not remember things 2-3 yrs ago.

Q: Can a person convicted of Domestic violence and assault be paroled to the same community where the victim lives?

My grand daughter and her mother were victims of assault with injury. He is currently serving state prison time. He is coming up for parole soon.

You are not legally separated. You can file in California since you have lived here at least six months and file in the county you have lived in for the last three months.

a lawyer needs a lot more info.

the lawyer could have meant he could not or did not get a dismissal/not guilty.

however it would not be grounds for dismissal but maybe a new trial for incompetency of counsel...........................if that was the case.

I assume you mean CPS?......any unlawful touching is a battery...........and could be an issue.

i suspect s/he described it as not light touching?

if you can afford one you should consider a lawyer in your area who deals with these kind of cases.

Not sure why not filed.......i would ask for an appointment with the head DA for that court to present your case and ask for a reconsideration of the facts.

If you are suing him your lawyer would be the best person to ask. Only your lawyer knows your game plan and you do not want to say anything that hurts either matter.

you need to talk to an immigration lawyer............from a criminal standpoint you can call police.

If arrested but not filed within a year that is long enough that a misdemeanor will not be filed..........a felony would be longer and DV could be either.

the records will probably be there forever but not available to the public
