All treatment providers have been payed, except for maybe one doctor. There was a dispute about claims that were paid by my auto insurance pip for treatment not done. Perhaps it was a medical coding error. All the attorneys that worked on my case left the firm. I am considering writing the firm a... View More

They should release those that are in excess of the amount in dispute. Find out what the hold up is.

As far as I see it the answer is NO.
How are you damaged?
Fortunately. There was no reason to have needed to use the insurance.
It is like being in a building and leaving. 5 minutes later the building collapsed.
You can't sue because the building COULD have collapsed when you were there
I was involved in a motorcycle accident where they were cited for being at fault. They have insurance, I do not. Is it possible for me to get a rental, as i have no vehicle, and the motorcycle is totaled?
answered on Aug 26, 2018
Yes it is possible. Oftentimes, if liability is not an issue, the adjuster for the at-fault party may authorize a rental and pay it directly. However, if the vehicle is totaled, they may either not pay you for a rental, or could authorize a short rental term while they are negotiating with you or... View More

I was in an auto accident where I received permanent injuries to my spine. The driver had a very small bodily injury coverage which I received the full amount in. I was informed by several people, as well as looking it up in the Florida state laws, that I can go after the driver/owner of the... View More

Upon receiving your settlement, you likely signed a release which means you can’t sue them for anything else. Also, you would have to go to court to a get judgment against them in order to potentially garnish their wages (not all income is garnishable). However, to go to court in a case like is... View More

You did not ask a question, but you seem to be wondering what to do in this situation. Also, I assume that the lawyer sent you some sort of demand regarding damages for bodily injury. The first step is to look at the police report - what does it say about who was in which car, and about bodily... View More
I was a passenger in an Uber accident. My attorney is harassing me for my insurance information so they can cover my medical bills.. I was a passenger, not a driver. This wasn't my fault. Why is my insurance company paying? Doesn't Uber have a 1,000,000 insurance policy?
answered on Aug 7, 2018
In Florida, your Personal Injury Protection (PIP) is your mandatory health insurance for auto-related injuries. It is also known as the No-Fault law. So, in any accident in which you are a driver or passenger, your own PIP pays your medical bills (80% of reimbursement rate) up to $10,000.00.
I was convicted of DUI manslaughter in 2003 and my license was revoked for life. I was sentenced to 10.375 years in FDOC and 3 years probation. With all this behind me I was hoping to get a hardship license and save money not paying for Uber rides.
answered on Jul 23, 2018
As long as you have no prior DUI convictions, you can petition for hardship after 5 years.
a person whose driving privilege has been permanently revoked because he has been convicted of DUI manslaughter and has no prior convictions for DUI-related offenses may, upon the expiration of 5... View More
On 7/3 daughter's auto fender bumped bicyclist's rear tire. FHP said no damages to bike (not even a blown rear tire!) or to auto (not even a scratch on fender!) and cited daughter for "moving violation" since bicyclist also didn't stop before riding his bike through a side... View More

If the claim has been made with the insurance company, you and your daughter definitely should give the insurance company her version of the incident.
I was parked in a fire lane and someone hit my car and ran off. I have witnesses and it happened in a parking lot in front of a salon she apparently owns so I'm going to go find her to resolve this but I just want to know who is at fault here?
answered on Jun 25, 2018
She is at fault. The fact that you parked in a fire lane probably did not contribute to the accident.

If you are requesting insurance disclosures, there is no official form. Instead, you send a letter requesting disclosures pursuant to Florida Statute 627.4137 (here is link: http://www.flsenate.gov/Laws/Statutes/2018/627.4137).

I have a broken nose, cuts and bruises on my face, neck and shoulder and my back is hurting. I went to the hospital that day, but I'm still in so much pain. Do I need to use my health insurance? I need help paying these medical bills.
answered on Jun 5, 2018
Your auto insurance (PIP) will cover your medical bills initially, up to $10,000 generally. You likely have a claim against the at-fault driver. You should consult with a personal injury attorney immediately. Most firms, like ours, offer free consultations.
off the hook?
answered on May 30, 2018
The fact that the other driver, whom is allegedly not at fault does not have a driver's license or a valid driver's license does not negate a finding of your own negligence. However, while I do not know the specifics of the accident, it may help in your defense to show that this... View More

It is definitely possible. It likely depends more on how/what caused the miscarriage in the first place. Without more facts, it is difficult to say exactly.
Cannot get Drs to care for me as ins co. Said I have no more health coverage.??
answered on May 19, 2018
Doctors, hospitals, etc. want to get paid for their services now. They generally don't wait for your claim/lawsuit against the other driver--which can last many months or even years--to conclude before they get paid. It is also a risk because if your claim is not successful for some reason,... View More
It also had a one million dollar umbrella policy from another insurance carrier In the accident I received several herniated disks and bilateral fracture at the L5 S1 question is can I put a claim in for both
answered on May 8, 2018
Yes you should retain counsel on contingency fee here in Florida and don’t give a statement to anyone. Lastly seek medical attention within the 14 day period following your accident to protect your PIP benefits which it looks like you did.
Im insured under my mom, however they have made a reservation of rights because the rental vehicle is not listed under her policy. The bodily injury limit is 10,000 per person , property damage limit is 25,000 per accident.

How much they can sue you for depends upon the extent of their damages. Unless there is bodily injury, what we are talking about is essentially no more than the value of their car (if it's "totaled"). And if they sue you, don't forget: the insurance company will pay for an... View More

answered on May 3, 2018
That's a tricky one to answer without more information. Some owners might have to go through their own collision coverage if there is not enough property damage coverage for all the damage. Yes you can pursue someone legally even if they do not have insurance or do not have enough insurance. However, the better question is whether it is worth it to go after such a person, as not everyone is collectible (e.g., not everyone has money to pay you). For example, if the person has... View More
