Turn it over to your insurance. If you had no insurance you need to enter an appearance otherwise you get another default.

You respond that you don't owe anything because it is "collateral estoppel" and "statute of limitations."

I have no idea what you are talking about. Someone loaned you a car, there was no insurance, and you were involved in an accident? If the accident resulted from your negligence, of course you are liable for the damage to the car.

Q: Will 2 police ports be linked if drivers in an accident filed them separately?

I was in a car accident recently in the middle of an intersection (under 5 mph thankfully) and at the time I was unaware of having to stay there so I moved to a nearby parking lot to avoid further danger. I immediately called the police but the other driver didn't follow me. If they file a... View More

If the other driver didn't follow you into the parking lot (where, I assume, the police met up with you), it is doubtful that police officers interviewed the other driver.

If they didn't, it doesn't seem that there would be another police report.

If they did, yes,...

This is a common problem for pizza delivery drivers. When insurance is purchased by the vehicle owner, there is a question that is always asked. Are you using the vehicle for personal or business uses? If you answer business uses, then your premiums will be higher in the form of a commercial... View More

You can get a copy of the fire rescue report and the police report. It may be a few days before the reports are available. You can also contact a personal injury attorney for further guidance. Hopefully, the driver had insurance and the police report is favorable to your point of view / version... View More

In Florida, a permanent injury is required to be entitled to pain and suffering related damages. You have a legal case to pursue; however, without insurance, it may be challenging down the line to collect anything from the at fault driver or at fault owner. It is unfortunate that the other driver... View More

If the driver decides to sue you for the personal injuries, you can defend yourself OR hire a private attorney to represent your interest. Since you did not have Bodily Injury insurance, the injured person and his or her attorney may not bother filing a lawsuit against you. It will all depend on... View More

Q: I was at fault in an accident, and the other party's insurance paid out a claim. Now the insurance is coming after me.

I am assuming this is because the claim was more than the limit, so they are coming after me for the difference, which is $25,000. I was called by their attorneys, and when I told them that I couldn't afford to pay that amount (even with only 10% down, the $150 a month) the rep kept saying... View More

.... was there a trial? If there was no trial you don't owe anything yet. If your insurance paid out I would be shocked if a signed release of all claims wasn't part of the payout arraignment. Call an attorney to discuss you situation in a bit more detail.

No, you should not speak directly to the insurance company, your lawyer should do all the speaking for you. At this point both applicable policies are looking for a reason to not pay you. You should seek medical attention immediately and content a lawyer after. These types of cases are handled... View More
