Q: My ex has my car that i paid for. He has the car because both names are on the car. He totaled it and wants the title.

There is a restraining order so this is why it’s difficult. What do i do about the car situation and the title? I believe he’s getting money from the insurance company.

Is your ex your ex husband? If so, does the Divorce Decree state who retains possession of the vehicle? Is the restraining order against you or your ex?

Q: Do I need an attorney ? My ex is trying to get a restraining order on me a month after our breakup.

I have screen shots from Facebook of our conversations and when I told her I am done with the relationship and I am applying for college she got angry and is now trying to put a restraining order on me. My court date is the 28 of this month.

Q: How can I motion to exclude evidence from discovery of a video that skips and lapse in time?

Can a plaintiff use a video that skips and lapse in time for evidence in their case or can I motion to exclude it from being seen?

If so, under what grounds can I motion?

Video goes up to minute 2 then skips to 2:30 to 3:15 then skips to 4:05, lot of the video seem altered.

You could do a motion in limine asking to bar the video due to lack of foundation. If it’s edited in some way, it has been altered and wouldn’t meet foundational requirements to be admissible evidence.

Q: Is this a conflict of interest? Should I get a new lawyer?

My lawyer is asked by the judge to submit extensions for my spouse's order of protection because they don't have an attorney. Isn't this a conflict of interest for me, and can't I just have my attorney not do it?

There is no conflict of interest. Your lawyer could hardly say no to the judge under these circumstances. It's a mere courtesy to the court.

You need to hire an attorney to assist you with this matter. Domestic Battery charges are very serious and could cause you issues for the rest of your life if you are convicted. The sooner you hire an attorney, the better.

Yes. You should be concerned.

DCFS and the local State's Attorney's Office in the County where you live could conclude that you placed your children at risk of harm and screen the case into juvenile court for a judge to make that determination.

You need a Criminal Defense Attorney if you have not hired one already. The State can force her to appear in court and if she fails to appear in court, the can ask the Judge to issue a warrant for her arrest. You need an attorney now.
