In the Northern District of Alabama Western Division - the Trustee does not take your EIC or Child Tax Credit

Yes, you have to file a succession to get title to the house and vehicles. It also might have to be administered depending on the debts. Just in general, the process can take anywhere from several weeks to several months for most cases.

Q: The company i work for changed my tax information with out my concent I started with a w-2 form with no dependents almot

3 years ago and now here a few months ago they changed my taxes from a w-2 form to a 10-99 form and changed my dependents to 99 and never gave me a notice or nothing isn't that illegal and can I sue them for doing that without my consent

You don't have a colorable lawsuit or any damages to speak of. Fix the situation with your employer/HR department, etc as soon as possible.

Q: If judgements don’t say anything about claiming kids for taxes can I claim them every year she is in arrears on support?

Have joint custody with me as custodial parent. Also have a child support judgement. She is in arrears do I have to let her claim a kid for tax purposes? Her child support is only been paid once by her taxes and once by stimulus check. Never by her or her job.

Claim both kids and hire a child support lawyer to file for a wage garnishment.

Q: In 2019, I got a refund check for tax year 2004. A year later, I was told it was an error and need to repay.

On January 31, 2019, we were issued a refund check of $1644.81 from the state of Louisiana. Hesitant, I held on to it until it was almost void. A year later, I received a letter stating that refund was issued in error and we have 45 days to pay it back. Am I responsible for their error?

Unfortunately you do have to return the funds if they were issued by mistake. If they are also trying to assess penalties and/or interest I would push back on that hard. The answer to this type of question generally depends on whether you filed a tax return. This very unfair situation is only one of many that go along with being married.

There is no law or rule requiring your spouse to file jointly; and even if you and your spouse did file jointly, there is no law or rule requiring him (or you) to split any refund.

Put your TX address on your Federal return.

Get a TX driver's license.

Intend to reside in TX indefinitely.

For any LA source income you would need to file a non-resident return.

The SSA allows you to ask for them to forgive an overpayment IF (1) the overpayment is not your fault and (2) making you reimburse the overpayment would create a financial hardship.
