Once upon a time, the traffic code only applied on public highways and streets maintained by the state or local governments. I won a lot of traffic cases for clients defending under this restriction, including a lot of probable cause stops for DUI based on not moving violations within apartment... View More

I left my car running and entered to buy a coffee. When I returned an officer cited me for leaving my car running. I just want to know if I could just pay the fine$60, if it is not a moving violation. Thanks

It is not a moving violation and does not carry points. The statute states that "(b) Except as otherwise provided in this section, on any highway outside of a business district or a residential district, a person may not leave any vehicle standing, without providing an unobstructed width of... I'm driving my brother's car and got ticket at parking lot. Ticket description: displaying expired LC plate, decal expired 2022. But I have record of renewing and did put sticker for 2023 (expired in March). Now the sticker isn't there and I was charged. Should I contest? What will I need?

Request a trial within 30 days and go to court. Bring proof that the tags were current and explain to the judge what happened. You should also replace the sticker and bring proof (a picture) of the new sticker. If the police officer appears, you will be acquitted. You can still have a trial even if... View More
My wife received a ticket for driving with suspended registration due to missing smog check yet I have paperwork showing the current smog check still has 8 months on it. The only option on the ticket is "request a trial" which seems way to much for what seems like a clerical error. Is... View More

You cannot clear this up without going to court. She should request a trial within 30 days of the ticket and go to court. She should bring proof that her registration is valid and the emissions test. She should be acquitted under these facts.
If both ways have green lights and no arrows. A driver turning left from one side, another turning right from the other, so both heading to the same spot. If they collide and the driver turning right did nothing to avoid, but driver turning left didn’t yield properly, who’s at fault? Does... View More

The vehicle turning left in your scenario must yield the right of way to the vehicle coming in the opposite direction and making the right turn. The vehicle making the left turn is at fault for the accident.
My son which is a black 21 year old male was recently arrested in Ocean City MD over the weekend 12/31/22 for what we can only see as him being profiled but we live in Virginia. He was told by the police officer that pulled him over that his license plates didn't match his car and that he... View More

Your son needs a criminal defense lawyer. Either he/you can afford private counsel, or he needs to apply for the Public Defender in the county where the charges are pending. The lawyer will obtain all of the discovery and evidence from the State (including officer dash video and body camera video... View More
I received a ticket (Maryland State 21, Subtitle 7 of the Transportation article violation) for driving past a stopped school bus with flashing lights and the stop sign extended in PG County, MD. You should request a trial and go to court. The judge will watch the video and you can testify to what happened. The judge will decide the case. If it was a camera ticket (as opposed to being stopped by a police officer), then there are no points assessed.
a lane change. I was stopped by highway police. Not understanding why?

If you received a traffic ticket, you should request a trial within 30 days of the ticket and go to court. If the police officer does not appear, you would be acquitted. If the police officer appears, you can have a trial. Even if you are convicted, the judge can offer probation before judgment... View More
It was on 01/11/2023 at 7:43 PM on I-95 North at MM 80. There was slight fog and I was using my High Beam of headlights. After a while a cop was following me for less than half mile and then gave me a ticket with Maryland's TA - 22-223 (c) in Harford county. Ticket says I need to pay $60 fine... View More

Subsection (c) of this section of the Code makes it a violation to drive behind another vehicle within 300 feet with your high beams on. It is unclear how this officer determined you were violating that section, as the officer was behind you. The charge is not a moving violation and carries no... View More

Great question! So, a camera ticket is mailed to the registered owner of the vehicle. Because obviously, the State has no idea who was driving, and the law presumes that it was the registered owner. But! It is a rebuttable presumption! The registered owner can contest the citation by identifying... View More

If your name is on the ticket, then it is your responsibility. If you fail to take care of it, your license will be suspended.
Now, if it is a moving violation, do not pay it. Request a trial within 30 days and go to court. You do not want to receive points on your license.

Yes. Look up the "Boulevard Rule" which applies in Maryland. Also read over MD Code, Transportation, § 21-705:

Can you be given a ticket for going 12 miles an hour over a 30 miles an hour instead of 13 miles an hour and find in MD speed camera?
answered on Nov 13, 2022
Speed cameras result in a ticket for $45 once you hit 12 mph over the posted speed. Doesn’t matter how much over. No points. Just pay the money. Insurance companies can’t use it as a basis to raise rates.
If a cop clocks your speed and pulls you over, however, it works like this: 0-9... View More

You can request a trial and go to court. If it was a camera ticket, the judge can watch the video and you can testify. The judge will decide whether you had time to stop.
If a police officer gave you a ticket, you should definitely request a trial and go to court since this ticket carries... View More

Next time they run the tag in Maryland, with an unpaid ticket, it gets the boot and a tow. Then you pay the tow, storage, unpaid fines that have doubled or tripled on the late penalties, in order to get you car out of hock. Municipal parking infractions do not impact visa or immigration determinations, unless perhaps if you do not pay the fine; however, anyone can challenge a parking ticket by requesting a trial. Paying it, however, will not impact your status or approval of any future application.

You should get a certified, complete copy of your driving record. This will prove that your license was valid on the date of the incident.
The ticket was for driving on suspended liscence after I called dmv they say my liscense wasn’t suspended

Hire a lawyer to file a motion to recall the bench warrant and reschedule the trial. Get a printout of your driving record. Give it to your lawyer.

Contact an attorney right away. This offense carries possible jail time and points. If you have a good driving record, jail is unlikely and an attorney should be able to keep the points off your record. You should also get your car insured before court which will make a big difference.
