No contract tenant

The process starts with what's called a Notice to Quit. You'll likely need to serve that and wait 30 days before proceeding to the next step.
I’ve moved my furniture out of the place, returned my keys, and have started the process of returning my deposit. Is there a written agreement in Michigan specifically that is required?
answered on Apr 14, 2021
A lease is a contract. Generally, the parties are bound by the provisions of a signed lease. Turning in the keys is a unilateral step only. Without the landlord's release, you would still be obligated on the contract.
Does the covid act help me for more time on getting out?

It is possible there are pandemic related protections in place, but those are ephemeral and case-by-location.
Here are some key points to be aware of:
(1) If you have a lease, with a defined term (for example until July 1, 2021), it is likely the landlord CANNOT remove you for any... View More

I don't believe so if the tenant has not already complied with the requirements for the moratorium.
Do I have a right to request termination of lease, before my move in date, if no one is responding to these concerns? I found pests(bedbugs) of what I believe to be an infestation as I was cleaning the unit. I have proof and I’ve contacted the agent and the Property Manager and sent them... View More

There's quite a lot of misconception around landlord and tenant laws. The Michigan Landlord Tenant handbook should be easy to find and will have some helpful information in it.
Anytime you break a contract, with a complete defense or not, you're risking retaliation (balance that... View More
However when I signed the new lease last July, they forced him to sign the lease because it was not enough notice. Now they are saying that I cannot leave this lease when it ends in July because he isn't giving notice. Can my landlord charge me month to month and hold me to the lease?
answered on Mar 30, 2021
See the landlord tenant handbook from the state of Michigan for perhaps a starting point, but you might benefit from a consultation from a lawyer.
It is common for residential leases to start with a 1-year term and continue in month-to-month terms until the landlord or tenant provides one... View More
Landlord claim received on the 6th, how do I know when received
answered on Mar 29, 2021
It is possible there is a rule written within the lease, so don't ignore that possibility.
Generally, the day you place rent in the mail, is the day rent is 'paid'. And the day rent was 'received' isn't usually important. If you involve a third-party payment... View More

Contact the district court in the county you live, but the filing fee is around $55 for possession without money damages, and more for money damages. Service of process fees might be around $40. Michigan has a landlord tenant handbook that is very helpful for landlords and tenants. This link might... View More

I couldn't figure out the exact situation from what was written, but these general guidelines might answer your question:
A landlord must go through the process of eviction to evict a tenant, the tenant may respond through the court to contest the eviction.
During the term of a... View More

answered on Mar 6, 2021
A landlord does not have a right to the security deposit until the tenant releases or loses the right to it, and usually occurs following the procedures set out in-part in the Landlord Tenant Relationship Act. It doesn't read to me that the landlord here has acquired the right to the security... View More
Is there a Michigan law section I can quote?

You may well be. If the landlord sues, he or she can collect from either or both of you.
I told the landlord that I wanted to stay he says the lease ends on the 31st and I have to move can they still make me move even though I never said I wanted to move
answered on Mar 3, 2021
Probably. Month-to-month leases, are generally considered a periodic tenancy, those that continue for successive fractions until terminated by proper notice by either party. The beginning date is certain, but the termination date is uncertain--that is--until notice is given. Termination of the... View More

This depends on how the occupancy arrangements are defined. GENERALLY speaking the life tenant is responsible for the current expenses like utilities, taxes and insurance but PRINCIPAL improvements are not required. A new roof could be seen as increasing the value rather than merely maintaining it... View More

Your question is a little vague.
There are certain procedures a landlord and tenant must follow to shift who takes the next step in a several step ladder to acquire the security deposit. You might take a look at the Landlord Tenant Handbook from the State of Michigan, you might be able to... View More
I am paid up and he is already trying to sell it without eviction notice
answered on Feb 10, 2021
Provided you are not in breach of the lease, missed a notice to quit, missed an eviction notice, missed eviction hearing, and any subsequent trial, it sounds like your landlord might be taking steps known as "self-help" and, subject to some really rare situations, unlawful.... View More

answered on Feb 10, 2021
Depends on the lease and rights conferred to you therein, but it is likely the landlord has a right to sell the property without telling you. The landlords will have to take steps to transfer your security deposit, and tell you where to send the new rent checks, however beyond that a real property... View More

This will all depend on the terms of lease, the flexibility of the landlord, and flexibility of your employer. You might be a assignee or under a sublease. With more information you could even be considered the tenant.

Generally, a landlord may not asses a charge against the tenant's security deposit for normal wear and tear. Normal wear and tear might include window coverings that degrade. answered on Feb 2, 2021
A little more information is necessary. But, if (1) your landlord provided the notice to quit, for whatever reason, and (2) waited the requisite number of days, and (3) then filed suit against you for eviction, but then (4) voluntarily dismissed the case against you. Then it sounds to me as if,... View More
