Q: Can I be held 100% responsible for backing into a illegally parked car blocking a business drivewa? Do they have a case?

No police report, driver might not have valid license, Complaint filed with small claims court has wrong date of incident(date filed 1/8/17 actual date of incident 9/1/17)

If you were backing up the answer is yes you CAN be held responsible even at 100% as this is determined by the judge. What will happen is up to the judge but just because the car was parked illegally does not give you the right to hit it. The wrong date seems to be your best defense.

No but you will not get your license for at least 6 months after everyone else.

Q: Negligent Collison. Points?

You don't get a ticket and thus points for negligent driving from MVC as that is a civil matter not a traffic matter. What you can get tickets for are specific infractions such as careless driving, failure to observe a light etc, etc. But remember you can get points from MVC and from your... View More

As long as you do not comingle any assets (meaning have nothing in any joint accounts) then you should be fine. If there is a judgment against him for 800,000, and he has other debts, and no assets, he MIGHT benefit from bankruptcy.

You can be sued regardless of what you plead. You can plead not guilty but you will have a problem if you hit someone in a crosswalk which you didn't see because your view was blocked.....and then you drove forward without seeing what was on your now unblocked field of view.

If you were hurt, contact a member of the NJ Assn for Justice--they give free consultations. File a report with the police, then if you have collision use it and let them go after him.

Your company is incorrect and trying to dodge your claim. However you could make a claim against the trucker and the company who left their rock there. Hopefully you took a picture of the rock in the road and police responded.

Q: is a seat belt ticket a moving violation? it was a $50 dollar fine, no points. It did not endanger a child.

If it was a moving violation, you would have received points from MVC on your license. That does not mean that the car insurance company can't and won't hit you with a surcharge.

The shop should take car of the damage to your car. I doubt you really have a psychological injury claim, but speak with a top notch PI counsel. Also report the accident to your carrier

Q: Drove after taking newly prescribed drug, met wit accident hurting other vehicle driver. Doc did not tell not to drive.

You need to hire a lawyer to file suit against your company for failure to honor the contract of insurance. Ask about bad faith, additional damages, and collecting attorney's fees.

Your lawyer may also suggest reporting this to your state insurance commissioner.

Your father maybe correct as there is, in NJ, Uninsured and Underinsured Motorist coverage. This goes into effect when the at fault person either does not have any insurance or has minimal insurance.
