Q: Life insurance beneficiary .

My ex-spouse recently passed away. I am his life insurance beneficiary. The policy was taken out before our marriage. Am I entitled to the benefits? I live in Pennsylvania

If you are the named beneficiary on the life insurance policy, you are entitled to the benefits.

Q: Hello, do I need a permit to advertise about an event that my non-profit is hosting? We have flyers and other papers

A volunteer group will be walking around door to door to advertise the event. We are not selling anything. We have flyers and other paper materials that we will be handing out to spread the word.

The answer to this question depends upon the county where you will be distributing the flyers. Even though you are not selling anything, the township may deem that handing out the flyers is a form of soliciting contributions, and there are townships that require permits for such an activity.

Q: I (plaintiff) filed a complaint for 70.000 USD becouse Defendant ( United Corrstack Paper Mill) refused the payment.

In his reply, the defendant engages in dishonest conduct, obstruct the discovery process and make a series of lies.

I have clear evidence for it.

How can I claim a default judgment? To whom to address such a request?

You cannot obtain a default judgment after the defendant had answered your complaint. If the facts are clear, you can move for summary judgment as a matter of law based on documents and affidavits.

Q: I want to start selling private label Hot sauce and salsa. I want to use my last name with the word salsa or hot sauce

" Last Name" Hot sauce or salsa. Do I need to get this trademarked to sell? Or I'm I allowed to start selling this online since its my last name and the word Salsa or Hot sauce.

You do not need to have a trademark to sell. However, the federal trademark does protect the name so others cannot come in and copy it. I would also recommend that you copyright your recipe for the sauce. Good luck!

Since Pennsylvania is not a community property state, your spouse is not liable for the debts of the sole proprietorship. However, if you have a joint bank account, the creditor could go after 50% of the account.

No you cannot file a new bankruptcy. If the claim pre-dates your bankruptcy, you may be able to reopen the bankruptcy. You may be able to file a state receivership, a state form of bankruptcy but need to speak to local counsel. Those are usually handled by bankruptcy attorneys.

Q: I am a small business owner and I have franchises business.I don't have any employee, do I need WC insurance?

My franchiser charge me worker compensation insurance on my annual sale income just after sale commissions . I have no employee at all. My franchiser's head office is in Huston, TX but the actual business location is in Pittsburgh, PA.

The policy as a whole sounds very strange. However generally an employer can only be held responsible if they don't hire you because of race,gender, religion, ethnicity etc. Consult a member of the Pa.

The non-profit statute requires that there be a board of directors. If they are the first incorporators all must sign the Articles of Incorporation.. They must be named at the end. The first bylaws should also be signed by the incorporators as they are acting as board members.

Q: How do I legally get out of a equipment lease ? They want me to pay full lease agreement.

Q: Can a company obligate its employees to work past paid hours, cite it as voluteer work, and terminate them if they don't

The company in question only pays its employees for 37.5 hours of work a week, yet forces them to work 45-50 hours a week, sometimes multiple jobs at once, and terminates them for bad performance if they refuse to "volunteer" these extra hours.

If they are paid overtime it's not a wage hour violation. If only paid for 37.5 it is a wage hour violation and you should consult an attorney who handles those cases.
