Q: What can I do if my income puts me just over the Obamacare cliff and I have to pay an extra 20k in taxes?

My income puts me just over the 400% threshold. If I made a little less I would not owe very much in taxes but now I owe 20k because I have to repay the full health insurance tax credit and I can’t afford it.

The first thing I would advise is to have your return prepared by a good CPA if you have not already done so. Make sure you use a good CPA and not a national chain. I advise you to contact a good tax attorney to discuss your options. Stay away from the places you see advertised on TV. There is not really any help we can offer online.

Q: Can the NC State Dept. Of Revenue garnish Tax refunds for taxes they say are owed from 1999 but the IRS has no record of

The NC Dept. Of Rev. has taken my tax return for the last 3years applying it to what they say is tax I owed from my 1999 sole proprietor business.. The IRS says they have no record of it they don't keep records past ten years

If you owe the IRS a debt that they are collecting on they should be able to provide you with an account transcript. Since they are saying they do not have a record of the debt, ask NC what the debt is for and ask for proof that it is owed.

Q: The irs is going to take my fathers house due to back taxes and alot of my personal items are in and around the premise.

Most personal items are not seized when a home is auctioned by the IRS. I strongly recommend that your father contact a tax attorney to see if there is any way to save his home. Just stay away from the places you see advertised on tv.

Go to the Connecticut Judicial Branch website. Under the Public tab you will see forms. Do a search for the forms that you need. No levy action should take place until the IRS reopens. Once they reopen you can call and try and have a new installment agreement set up.

When you set up a corporation you have to pay yourself at least the average rate for your job in your area. So no it is likely that everything you make would need to be paid as income.

When you file married filing jointly as far as the IRS is concerned you are both liable. Even if you have a divorce decree that says differntly the IRS does not have to abide by the divorce agreement.

It is not retroactive so you will still owe the penalty. Did you look into whether you were exempt?

File an amended return. The IRS does not criminally prosecute for honest mistakes. They are looking for cases of fraud or tax evasion. If the other garnishment is for federal taxes then you may be eligible to have the amount reduced or have the garnishment stopped completely. It is impossible to tell without doing a financial analysis. Most of us offer a free consultation and can let you know your options.
