Q: I have a DUI homicide case on my record, can I apply as a petitioner to have my fiance come and marry me with a K1 VISA?

I was 17 years old when it happened. My sentence was 5 years prison time 5 years extended suppervision. Im 32 now and its the only blemish on my record.

The USCIS usually weighs the criminal background of the intending immigrant for eligibility. The criminal records of the sponsoring Finance/spouse typically will not be considered. Just make sure you are an upstanding citizen now and paying taxes.

Hi, as of right now, there is no new law regarding long stays outside the U.S.for GC holders. There is no harm in gathering documents regarding your travels. It could come handy when you apply for Naturalization.

The Attorney of record does not have to be the preparer. Reviewing is different from preparing in my experience.

Hey, your child should be able to sponsor you with no problem assuming you are not inadmissible for any other reason. Even though you have stayed in the U.S illegally, there is forgiveness for immediate relatives of a US Citizen ( Spouse, Child Under 21, Parent).
