Different attorneys charge different rates. So you will have to call and consult with the attorneys and give them the details of the matter before they can quote you their fees.

Q: Bought 2000, foundation crack 2023. Soils engineer looked at the home for the orig.owner. Owner never disclosed issue.

Since the soils report, and foundation issue, was known but not disclosed in our purchase documents, and the settling cracks were evident only a few years ago, can I hold the owner/ agent responsible for the repairs I need to make to the home to fix the foundation.

It depends. A real estate attorney would need to review all purchase documents and the expert reports to determine your legal options. You may also have to pay an attorney to take on such a case given it’s been 23 years.

Q: Can creditor agree to lower payments, then charge off, then settle, then sue for original amount plus interest?

Finwise/upstart agreed to lower payments. While making lower payments they charged off loan to debt collection. 6 months later they settled through a different debt collector. Now charge off debt collector is suing for full amount plus fees.

Q: Carvana is delaying my registration to a vehicle and the temp tags have expired.

They also forced me into buying this car. They contract was rewritten but I never signed it. They placed my e signature on the rewritten contract.

Q: Can a charged off loan continue to report late payment every month? It's been 4 years.

Navient Private student loan. The loan was closed (charged off) 4 years ago, but every month they report it late. My score dropped over 100 points when it was charged off and I have been able to increase it a little bit but the monthly late payment report from them continues to hurt me.

Depends on the settlement agreement. Most settlements are for all claims and you would be precluded in most circumstances from bringing additional claims once you agree to a settlement.

Q: I had paid someone over $35,000 to build the box for my semi truck. He never did, Can I sue him?

It is 1 year past the deadline. It is very rare when he responds and he just keeps saying he will start to work on it soon. When asked for the money back he says he does not have it.

You can sue for breach of contract. Given the amount it would be unlimited court. You will want to consider hiring an attorney to do this properly.

It’s against the law to sell a vehicle that doesn’t pass smog. Contact an auto fraud attorney for a full consultation. Have all your paperwork ready to be sent to the atttorney.

Power of attorney is not valid after death. If there was no living trust, then the estate has to go through probate for the property to be passed to heirs. You are not required to sign it but the employer may terminate employment if they deem this as important to them for continued employment. So maybe he wants to look for a new job asap if he needs a job.

There are many collection scams out there. Make sure you take the paperwork you received to a consumer protection attorney that has experience with debt collection and have a consultation.

it is not illegal to be charged a downpayment for a purchase of a vehicle, even one that is being financed.
