did you report it to the police or talk to the police at the time of the incident?

they can subpoena you and if testifying would incriminate you, then you could take the 5th.

it is like asking a doctor over the phone for med advice without exam, xrays, history etc

ie, what is your prior record? for what are you on probation? how long ago? same court?

i am guessing you have a lawyer with you, either retained or appointed.

s/he is the best person to follow.

if you don't, ask the court to appoint a public defender.

this is not a case i would handle.

however, there are lot of reasons for rejecting a case.

most of my friends who do med mal will not take a case worth less than $1Million dollars.

they are very costly to litigate.......if you offer to front costs they may take it....

it is up to the DA...........however, i would never suggest a defendant just show up in court without a lawyer.

you run the risk of some judges putting you in custody if you did not show for an appearance without good cause.......if this is your first appearance that should not be an issue....

however, the question you are posing is one best answered by a doctor, not a lawyer.

a lawyer might represent someone who has to sue a doctor for malpractice, by providing the wrong info,that results in damages.

legally yes.

However, most lawyers do not want to take a case at the last minute and be forced to file without having all the evidence................unless it is a major case with good supportive evidence.

an attorney would want to go into more detail as to the facts of this matter.

the pivotal question is whether you were insured at the time of the accident. That company would continue to be contractually liable to pay whatever you can approve.

the first thing you should do is set up a consultation with a local criminal lawyer, and if you can't afford one ask for a public defender.

write out a summary for the lawyer with detailed facts, names, addresses, phones, emails etc of all involved.

I assume this was the medical bills for your treatment on a lien, meaning the med facility would be paid when your case was resolved.
