no.........not if it is accidental................

this is not a PI or DUI/DV question.

it is best handled by a real estate lawyer.

however, it is my understanding that an Unlawful Detainer would have to be brought and or a Restraining order if the facts warrant it.

write them to explain the issue and give them X days to respond or you will pursue any and all remedies at your disposal.

if damages are less than $10k consider small claims as you get to court right away.........

if you were not arrested and no case was filed, then there is nothing to Dismiss under 1382.

people in your position have to go to the governor and you don't want to waste your money doing that.

who is your lawyer?

any attempts on your own to show you are a good person? ie Rehab?

Ins Co'S DO NOT HAVE TO SETTLE CASES.

THEY CAN TAKE THE POSITION, THEIR DRIVER WAS NOT AT FAULT AND THAT YOU MUST GO TO TRIAL TO PROVE THEIR INSURED WAS AT FAULT.

call the police to report the theft.

send a letter to Tow Yard setting forth what happened with copies of pix.

demand reimbursement and if no response or no payment, sue in small claims court.
