Probably not since he is not 18. Once he turns 18 the parents will have no say so at that point. Good luck.

Yes the mother can move where ever she pleases unless the father initiates a court order with rules into place. The father should retain an attorney for these matters asap. Good luck. 888-343-4529.

It must be heartbreaking to be without your kids especially for the holidays. See if you can get the CPS orders or plans and then take them to retain your own attorney to pursue the proper course of action. Make sure you have all orders as it relates to the children before consulting with an... View More

Q: Is visitation different for children 3 months old? My sons dad moved 3 or more hrs away and now wants to be involved.

My sons dad was not involved during the pregnancy and even wanted to give up his rights at one point. I am having a hard time wanting to send my son 3 hrs away. However, I let his dad come get him last weekend and that whole week after my son came home his sleep schedule was off. His dad wants to... View More

Visitation for children is done in the best interests of the child. Factors to consider for overnight are whether the father was living with you and if so did he keep the child overnights before he moved. In general long overnight periods for a newborn at 3 months would not be likely. But, there... View More

Your son has an option to be heard by the judge considering the case. Overall, the court will see if it is in the best interest of the child to act accordingly. Good luck.

If you do not follow it correctly then you could be held in contempt of court. Orders can be different although there are standard orders. But, all people do not have to... View More

In general just make sure that your child is well cared for and that the child has its own room if possible. A lot of courts believe that is important. Good luck with your life.

Q: In a family law ordeal, do I have the right to know allegations against me as soon as they rise? Or how soon after?

I have a CPS case and new allegations arose that can put me in jail for something I never did. I already know several of my rights have been violated but not very proficient in the allegations area.

Get an attorney that handles CPS cases and criminal cases as well since you stated possible jail time is involved. If you have a warrant out for your arrest you can check with bond companies to verify. Good luck.

Introducing your kids to a new father figure in their lives could affect the way the judge views your case. You should divorce and end things properly. I've seen a mother lose custody of her kids because she moved in with someone that she had met.

You can file a motion to modify. But, the best and most efficient way of doing so would be for both parties to agree and then one party hires an attorney to draft paperwork. Since these kids are 15 and 17 a long drawn out fight would not be productive.

The property would be awarded to your spouse in the decree, if in fact she purchases it before divorce is... View More
