Definitely. But they could be considered partially at fault if the over limit contributed to the crash or to the injuries, for example, not wearing seatbelt.

Failed to fulfill their duties and little regard to Ethics code that is supposed to be followed… Failed to apply well known law rulings applicable. This is in relation to personal injury claim/suit where I was 100% not at fault.

Early on in the claim the insured insurance carrier stated that they would reimburse reasonable rental if their insured was at fault. The out of pocket expenses were $4300 and they are offering to pay $1800. Do I have any recourse?

Q: I filed a civil suit against someone due to damages to my car from a board falling out of truck on freeway.

But I realized that the copy of the pictures for evidence that everyone got was black and white. But mine is in color. Can I bring in the color pictures for the Civil and use them or any new evidence for the Civil suit?

Q: what should i do if i havent made a payment towards my car insurance and my car caught fire

my card on file was on auto pay, i received a new card and didnt notice the insurance hadnt been paid. i never received any form of notice informing me the payment was declined. resulting in the cancellation of my insurance.

If your insurance was canceled due to nonpayment of the premium, you’re going to have to pay for the repairs or buy a new car out of pocket. I wouldn’t expect insurance to cover it.

The other driver is responsible.

Q: Is there a minimum amount of damage that has to a cure in order to receive a ticket in a traffic accident.

this involved a commerical vehicle and the officer told my wife that it wasn't over 2500 dollers in damage so no ticket was issued to the cdl driver. he rear ended my car and dented the bumper witch us going to cost about a grand .
