No one can give legal advice on how to handle a violent assault when you are armed. However I can advise you on several legal grounds. First, unless you have a concealed weapons permit, you cannot carry a firearm that isn’t in plain view. Second, lethal force to defend yourself is only permitted... View More

You should be discussing this with your criminal defense lawyer instead of an attorney on a blog who does not know all the facts and nuances

Your question is too broad, duress that led to a confession, or to commit a crime. Most case law can be researched on Westlaw, or LexisNexis but you have to subscribe to their paid service to have access. I would suggest you hire a lawyer and not try to navigate that field on your own.

You should contact an attorney so they can properly counsel you on whether Record Expungement would be applicable.

I am not sure I understand the question. How many pending charges are there and how many charges have already been resolved with a plea? The court only considers convictions, not pending cases in determining sentences.
And their corporate company is fully aware- the dude they hired, is indeed on the registry list for aggravated child molestation & still allow him to work around with children in a very uncomfortably close building? I do NOT approve... idgaf what corporate says, he needs to find a job... View More

This is not a federal crime.
Now that you have vented what is your question?
Do you have to serve jail time, or can you just get help and counseling

Without knowing all the facts involved, no attorney can render an opinion.
Hire an attorney
He's currently in there based on a statement given . In the statement the person said he had a gun so he's been charged with possession of a firearm but when they searched him they didn't find a fire arm but he's still being charged with possession.

Does he not have a bond? What about a lawyer? 8 months is a long time, but it does happen.
Shes been lying about having a huge house. Getting shot and still going straight to work. Finding images off of google in police cars and crime scenes. Telling everyone her first day on the job she busted a big drug raid, traffic stops and high speed chase.

It is a felony to impersonate a police officer. Just posting a photo dressed as a cop isn't enough. Nor is talking smack. But if they try to arrest someone or pull someone over they will be going to jail.
My fiance is currently locked up because of a bench warrant was issued for his arrest. We never received a summons to court so we didn't know of the trial date. We received the warrant in the mail, which confused the sheriffs department considering they didn't have the warrant yet. There... View More

The choice is simple: hire an attorney, do nothing or your fiance (not you because you are not a lawyer) files papers with the court seeking to change the no bond. Alternatively, he can contact the prosecutor's officer but from what you wrote, that does not appear to be a viable approach.... View More

Do you have a lawyer defending these charges? You need to worry about defending the charges prior to suing anyone.

You can apply for a pardon. You have to show the governor that you've lived a crime free life and you have to get letters demonstrating the hardship the conviction is creating. Pardons are not guaranteed, but this may be your best shot at this point. Talk to a local attorney about assisting... View More

Both parties are white. My brother is believed to be mentally ill/ and or using mind altering drugs. He has a public defender, should we spring for a private lawyer? Additionally, what is likely to happen now? He is not yet booked into jail.
answered on May 14, 2018
I always encourage clients to hire private attorneys to represent them. Most private attorneys will have fewer than 50 cases to work on while public defenders typically have 250-300 cases at a time.
