You r liable for child support for your daughter on birth certificate til she is 18. She can file for c.s. forward, not backward. It is based on your curent income but could be averaged if u have a job that fluctuates.

Q: If my child's mother is the one who put me on child support can she also take me off or is that up to a judge?

Also if I owe her money due to not working would she be able to forgive my debit so I can start off fresh?

If the money is not owed to the state, you and she can pretty much work out whatever you want.

As long as it is not unconscionable.

Nothing counts until a judge approves it.

The child stays with his grandmother and she receives no support from the mother who has been in and out of the penal system for years. Looks like she is using grandma for permanent babysitting.

You can go to court to ask for a Parenting Plan favorable to you since mom does not want to be involved.

No back support. Yes, she can file for cs. And a parenting time schedule can be put in place. The circumstances of ur older children, unless in college, do not have any bearing on this one.

Your best bet is to go back to your attorney a month or two before the child's 18th birthday and have them file a petition asking the court to set a specific cut-off date for the support. You may still be liable for the expense of secondary education, but you will have clearly established when... View More

If there was only one child and he was paying support and the child died, he needs to go to court to terminate it.

As to the car, depending on how the divorcement reads, she may be in contempt for failure to make the payments.

Q: I didn’t know I was pregnant, had baby, now not my boyfriend, but a coworker is claiming paternity. Can he get rights?

I understand they will order a DNA test, however, if he is my baby’s father this will mean he raped me (he admitted in text I was blacked out drunk and assumed I was on birth control) and didn’t tell me he was not safe. How likely would it be that he can get rights to my baby? I was already 35... View More

You need to see a lawyer ASAP. You're right about a DNA test being necessary. If you haven't deleted the text message yet, be sure you keep it. The public policy of the State of Illinois favors both parents having a relationship with a child, so yes, he may have rights. Off the top of my... View More

Talk to a lawyer about filing the divorce. He or she should include a request for child support, so it can all be done in the same proceeding. You can get temporary support paid during the time the divorce is working its way through court.

Q: Under the new Illinois child support law what if my ex who has my daughter more in parenting plan refuse to work but can

I have my daughter 143 overnights my ex husband got mad at current employeer and stormed out of his job. Since he is more than capable of having a job will this go into play. I feel as if he only wants her to get money out of me like when we were married.

As a general rule, the courts will impute income to a parent who manipulates the system to reduce or eliminate their income. In other words, if the ex was making $500 per week and quits his job without a valid reason, the courts will treat him as if he continues to make $500 per week when... View More

I don't know if you are working with an attorney or not, and I don't know if you are married with him or not. I would suggest that you should consult with an attorney, either a private attorney or the State's Attorney.

It has parenting plans which spell out responsibilities of the parents and who has them and when.

If you two cannot agree, the court will order mediation and if that doesn't work, hold a hearing and decide.

If you want support you've got to go to court and ask for it. To get it you'll need to prove he's the biological father with DNA tests, unless he admits he's the father in court. The court can order the DNA tests be taken.

If he is found to be the father the court can...
