Q: I made 36k. Guessing ex made 55k+. 1 kid. Between CS and daycare I pay about 950 a month. Paying to much? What can i do?

I need to move out of my Mom's house, but can't afford anything due to CS and daycare. And I'm also 15k in debt from the divorce.

It was court ordered for nc parent to claim my son. The court order never states u til he was 18 and I never signed a further agreement. I'm being taken to court because I claimed my son in 2015-16 and being told that I disobeyed the court order.

The exact wording of the court order is the key. For example, does it say the non-custodial parent can claim your son "beginning in 2014" or other language indicating his right to make the claim was ongoing? Or does it say the non-custodial parent can claim your son "in 2014"... View More

The court is mandated to order child support. It must do so unless it can justify reserving the issue of child support, but the court must be able to justify why no child support is being ordered at the time. Child support is the child's right, and you, the parent, cannot waive the child's right.

If the mother has constantly failed after going to court trying to give up her rights, it should be evident that she can't do so as a way of avoiding her obligation to support the children. I have found that this depends on the county and on the judge. It does happen.

Yes, for some people, it is doable without an attorney. However, it is not recommended because the average person rarely knows what is necessary to get the job done properly. Finding out what it takes is a very big job, which is extremely frustrating and overbearing.

Q: no there's no court order. i have been doing research because he haven't paid for child support and it's been a year.

can he go to jail? his been looking for a job and no luck yet. what should we do so he doesn't get in trouble? we are having financial issues because im the only one is working.

If there is no court order, there is nothing to modify.

He should go to court and establish paternity and have the judge reserve child support pending his getting a job.

You don't owe his child support.

Is there a court order for him to pay support. If so, he needs to go to court to modify it to reduce and/or stop it.

Q: If both parties agree in not having child support is there a form or anything we need to put in our divorce papers?

Me and the other party also have a parenting plan where it states we do not want a child support order. Can the judge also put one in order even if both parties agree in not having a support order

The judge can find it to be in the best interest of the child or children that one of you pays child support to the other and order it even if neither one of you wants it.

Q: Left wife for Brit. Brit is bipolar, but on meds. Have 30/70 temp custody. Wife wants brit's name on custody form,

If she thinks that the kids are in danger , she can do what she thinks is appropriate. That does not mean that a Judge would agree with her. If you are being pressured and you both are not coming to an agreement, you need to get a Judge involved.
