Q: Do I owe taxes to the IRS for a personal injury settlement?

I received a settlement in 2017 for a personal injury suit. In June of this year the IRS advised that I owe tax on this. I never received a 1099 for the settlement. The IRS stated I need to go through a tax attorney. I have very limited income at this time and not sure how to proceed.

How to get stimulus payment? I listed myself as homemaker and didn’t file injured spouse claim. I don’t think it’s fair that me and my kids don’t get anything is there something I could do?

There are only two requirements for anyone to receive the stimulus check: Filing an income tax return for 2018 or 2019 (2019 tax returns can be filed anytime, but--because of the pandemic--they are not due until August of September, 2020); and still be alive and breathing.

For IRS purposes whichever parent provided more than half of the support for the child is the custodial parent and is entitled to claim the child.

To transfer that right to the other parent requires a Form 8332. A verbal promise is not enforceable.

If you filed a joint return with your ex husband you are entitled to a copy of the joint return. However, if you intend to give your copy to another tax preparer, then your ex husband will have to consent to the release of HIS confidential information.

Q: Is it legal for my husband to withhold our joint filed taxes from me?

He has refused to let me have any of the $750 rapid refund we were approved for. He then took every bit of the remaining funds off of the card. Due to his abusive alcoholism we are not staying together as of 2/13/20.

Did you report any income on the joint return that contributed to the refund? If so, you may be entitled to injured spouse relief.

Q: Is there a way to waive the 10% fee for early withdrawal of a 401k due to personal injury resulting in job loss?

My husband was involved in a rear end collision that caused damage to his spine. He will soon lose his physically demanding job due to his injury. We need to withdraw from his 401k - would this situation exempt us from paying the 10% penalty for early withdrawal? Thank you!

Q: What are the rules for the foster parents adding my kids on their taxes

DCS is saying that to foster parents are allowed to clean my kids on their taxes but I don't think that is right but they won't tell me the rules on why they can my kids were only in DCS care for maybe 5 months

If a government agency has placed the children with a family then that qualifies for the relationship test required to claim the child as a dependent.

Assuming the other factors are in line they would be allowed to claim the child.

This is very common in foster situations.

You have to be divorced or legally separated, not just living separate, to file any way other than Married Joint or Married Separate....

Yes.

You can try to challenge it but odds are exceedingly low you'll see that money. Once they put the letter in the mail to the last known address they've fulfilled their obligation.

The answer depends on if same was exempted out. Some states follow the federal exemptions and some go with State Exemptions. Talk to your counsel about same and make sure it was properly exempted out.
