You could file a motion in the CPS case to possibly be awarded temporary custody by the court. Since you have never had possession or provided for this child, you do not have standing to file for custody as a “de facto” custodian. Your only shot is with the court in the dependency action.

You will have to to file a petition for adoption. If they are both on board to terminate and allow you to adopt, it shouldn’t be difficult at all. Contact a lawyer who does adoptions in your area and consult them. You will need help getting it done.

Not unless you can prove they knew the puppy had lice and failed to treat her. In addition, your adoption contract probably has language making it your responsibility after the adoption is complete.

If your husband is willing to adopt her, he can file a petition for adoption. If your ex defaults or doesn’t contest it, it very likely will be granted. If he does contest it, you will have to show that he is an unfit parent (ie prison, abandonment, lack of acknowledgment of child) and that it... View More

You file a petition for custody in the county where you live alleging that you are the de facto custodian. Mom and dad will have to be served. If he’s in prison and she’s in Fl, should be easy to do. Consult a family law attorney near you to help you file the petition.
