You need to file to terminate the child support that you were paying to mom and you need to file to establish child support for mom to pay you. They will not address child support in a custody hearing unless you also filed for child support.

Child support is between the parents. The spouse has no legal obligation to provide support to the child.
What do I need to do to get this back child support? I have expenses that I incurred to financially support our children for the past 20 years independently.

Consult a lawyer about this. It depends on when the child support order was entered, if the arrests or any part of the arrears was reduced to a monetary judgment, and how long it has been since the order and/or judgment has been entered. Generally, court orders for child support remain active... View More

Your father can file to modify custody. He does not need your mother's permission to do so. Also in the state of Maryland, you can petition the court in your own right to modify YOUR custody. If your sister is under 16, she cannot do it herself.

If you want to get a divorce and modify your child support, then you must file for divorce and you must file a modification with the court. As there is not an actual question here, I am not sure what advice you are seeking regarding those issues. You may want to schedule a consult with an attorney.

It ends at 18 OR graduation from high school whichever is later. It does not last until the 19th birthday.
We have shared custody 50/50, but the monthly child support I pay is significant. Should this be calculated on her earning potential instead of her actual since she chooses to work part time and is using my child support her?

Child support is based on actual income, not speculation of what someone thinks she could be making.
My daughter has been under my sole care until she was 4 months old, but due to an abusive situation at my parents, we had to move in with her father( the only other person we know in Maryland.) It’s a complicated question. With no court order in effect, either parent has legal authority to have physical custody and can move out of state. However, because this is the child’s home state of residence, Maryland courts have jurisdiction to hear a custody dispute under the Uniform Child... View More
Her mother signed her drop out papers. She is not in school
answered on May 22, 2019
If there is a current child support order, file to terminate immediately. It will not happen unless you file. The Mother probably will not. If it is going through child support enforcement they do not keep track of the age of the children and modify it for you. You must act.

If he actually said that in court, he is not getting joint custody. One of the factors in determining custody is sincerity of request. The parent has to want to have the child, not just want to get out of child support.
The court will consider the totality of the situation in... View More

Child support ends at age 18 in Maryland. Unless there is a written agreement between the parties, there is no obligation for either parent to pay for college.

When exactly does support end? The beginning of the month of graduation? do I pro rate the payment to the day of graduation?

You pay the whole month in which she graduates. So, if school ends June 20, you aow all of June on June 1, and then you're done. You do not get to pro rate.

You MUST file to modify the child support. As long as the order is in place, it must be followed. If she will not modify it, you must.

Yes. You can file a motion to modify child support but be prepared to prove with evidence that the child is no longer staying the requisite overnights. As a cautionary measure, I would also file a motion to modify custody. The courts may very well not modify child support until the custody is... View More
Ex-wife is attempting to register/modify the child support order in VA, which was issued in MD. I still live in MD. Can I contest the registration/modification process?

She can register it another state to enforce, but that state will abide by MD law when modifying it. MD law controls.
He says I have to pay while she is still being schooled? Is this true?
answered on Feb 27, 2019
Not true. If the child is 18 and still enrolled in school, then yes, but once the child turns 19 your obligation stops. HOWEVER, if you have a court order to pay, it does not stop automatically, you should file a motion to terminate child support based on the fact that she is 19. If you have an... View More

Typically, an Order of Default is granted in these types of scenarios but also the other parent may show up for the hearing, even though the other parent didn't file an Answer. Regardless, testimony will be taken a the hearing and the Judge will make a ruling based on the testimony and evidence.
