It is highly unusual for them to not put the controlled substance; however, the information should be further explained in a supplemental report. Your best bet is going to be to get with an experienced criminal defense lawyer to talk about the ins and outs of the case. While the wrong information... Read more »

It really depends on how bad the information is. If it is a completely different vehicle and absolutely nothing matches up, then there is a better chance of having the ticket thrown out, or at the very least casting the officer's story into question.

Q: If the officer pulled me over without reason & violated multiple rules n conduction of stop , would he even file charges

Have there been certain circumstances where a ticket or affidavit isn’t filed because the officer knew he did multiple things wrong

It really depends on the circumstances. Lots of officers will still file charges regardless of their own conduct; however, if an officer has said that they are pressing charges, then the best thing to do would be to follow up with the local court periodically to see if they did.

Without more information, it's very hard to answer your question. Generally speaking, officers and prosecutors have a lot of discretion when it comes to prosecuting or pursuing charges against a person. Even if charges are filed, they can decide to drop the case or drop only certain parts of it.

Typically, unless your name is on the ticket, then there is not proper notice of a charge. Regardless, because you provided a placard, you have a good chance at getting the ticket dismissed, assuming that the officer turned in the ticket. Your best bet is probably going to be to contact the court... Read more »

Q: I got a ticket for window tint being too dark. Can proof of it being within legal limits still be provided after court?

The court said I had to pay it. However, a reputable business did the tint and when I got it tested by another business, it is indeed legal all the way around the car. How can I provide this to court after I've already had court? It seems asinine (and more like theft) to force someone to pay a... Read more »

Unfortunately, if you have already been found guilty, then you are precluded from being able to bring in new evidence that you could have gotten prior to your court date.

Q: Can an EMS pull you over?

I came up on an accident as I was headed home from work. As I approached the scene I was flagged to come on by so I proceeded through. The issuance of a citation/ticket under these circumstances is most likely valid, however the ticket is simply an accusation that you committed an infraction-----based on your post, there are legal defenses available to you, as well as perhaps the less than common sense of the EMS people out there,... Q: What if the traffic ticket got the wrong year of the car on it. It's a 2002 Chevy Impala not a 2023 Chevy Impala.

I got 2 traffic ticket yesterday. Both of them got the year of the car 2023 but it's a 2002 model. Can I get both of the tickets dismissed by a judge because of that mistake?

Unfortunately, with the way that traffic tickets work in Mississippi, the fact that the law enforcement officer wrote down the wrong year does not automatically lead to a dismissal, as it is considered a simple error.
