The allegations are very serious. The potential exists for there to be felony charges depending on if there was in fact a serious bodily injury. It is vital that your son not talk to the police or DCYF without speaking to a defense lawyer. The facts may also reveal that it was not a criminal... View More

Q: My 4yo daughter just starting pre-school the school is asking to see my divorce papers and parenting plan is that legal?

They are demanding it, I told them what the parenting plan is and they don't like it and they say they will take action to change it. That doesn't sound legal to me, my ex isn't gonna do more then he already does, he's a dead beat dad. The court made him do the bare min if he... View More

The school might request the parenting plan to determine who can pickup the children on specific days. They certainly don't have grounds to ask for it to be changed or modified.

My husband wants a divorce. But we are doing it amicably and he wants to keep me on his health insurance due to my health issues. He wants to have it written into the final papers. A New Hampshire attorney could advise best, but your question remains open for three weeks. I can only speak for the insurance law-based attributes of your question, not the divorce-related ones. But as a general matter, courts do not usually have the power to change insurance policies. If the... View More

Q: My husband and I want a divorce but want to refinance the house, I get the equity and he gets the house.

Do we do this before, after or during the divorce? I need the money for a new start for me and my children but I’m afraid I won’t get it somehow.

The best way is for the two of you to meet with an attorney mediator who will help you identify and resolve all the financial issues at one time. Once you reach an agreement you can decide when you would like to refinance. You can then file your agreement with the Court along with a joint... View More

This answer to this question depends on the terms of your Divorce Decree. If your Decree states that he is solely responsible for these expenses, then he cannot force you to contribute. In contrast, if the Decree states that you are required to make some contribution to those expenses, then he... View More

Q: Wife and kids moved in March to MA kids finished school in NH till the end of June. Where were they considered residents

She is claiming they have the 6 months needed residence for the kids for her to try to have the divorce moved to MA. Are they considered NH residents still while they still went to school in NH? I filed in October for the divorce.

The children's residence will most likely be determined to be where they live not where they attend school. March was quite some time ago so it really will depend on where they resided for all that time. I wonder if the school has the children's address listed in Mass or NH? Be careful... View More

Q: Is there anyone in NH that can interpret RSA 458:26 1 as to the word "might" ?

I'm a little confused about what you're asking. You say "neither party can divorce" except for those situations, but I assume that's a religious limitation, not a legal one. That would have no effect on interpretation of the statute.

Q: I'm seeking to divorce my spouse. About 2 years ago we purchased a home. Loan is in my name but they're on the deed too.

I don't want the house--I want to be free and clear of it. What are my options? Can an attorney help me with this and my divorce? My spouse can be quite adversarial so would want to work through an attorney if possible.
