Yes, you do. But you cannot do it by this post here. Look in the list of attorneys for WA for a traffic ticket attorney or Google them. Thank you for using Justia's Ask a Lawyer, but don't rely on what you are told here, consult a local attorney who will obtain all the facts from you and... View More

Speeding and no license in possession are pretty minor offenses (depending on speed and location). Should not affect probation. But if it was a suspended license, could be more serious. Lots of attorneys practice Traffic Ticket law in OR. Call one. Thanks for using Justia ask a lawyer.
I got a traffic violation for going 46mph in a 30mph. Once I reviewed the ticket I noticed the vehicle information was incorrect the license plate says it’s from OR when the car actually has a Californian plate due to it being a rental. Is this enough to get my ticket dismissed ? How would I go... View More

An incorrect vehicle information on a traffic ticket may not automatically result in dismissal of the ticket. However, it could potentially be used as a defense if you choose to contest the ticket. To address this issue, you can gather evidence to prove that the vehicle information on the ticket is... View More

No good deed goes unpunished it seems. Explain what happened to the judge and ask for a dismissal. I recommend you contact several attorneys in your area that practice this type of law, as soon as possible. Thank you for using Justia ask a lawyer.
Hello I got a cellphone usage citation today with a 270 dollar fine, I was curious if this goes into your driving record and what should I do,I have never had another ticket before, should I pay fine or appeal thankyou all

You can contact a traffic ticket attorney or the PD and ask if this is a point count ticket, if no, it is not on your record as a point. It always goes on your record. You should also call your insurance company to find out if they will raise your rates for such a ticket, and how much. Then you can... View More
I reside in Oregon near the northern boarder, and I frequently visit the neighboring state of Washington. I'm specifically talking about a motorcycle with a modulating rear brake light. In Oregon ORS 816.100 allows motorcycles to have a flashing brake light. In Washington under RCW 46.37.280... View More

I think you should be OK as long as you don't move to WA, or reside there for more than 10 days (unless you can prove it was a short vacation). The Commerce Clause of the US Constitution (you heard of that right??? Just kidding) says that no state may pass any laws that unduly burden... View More
I got a ticket (violation) with two citations: speed 78/55 and pass in no pass zone. The specific circumstance involved the car in front of me slowing down and moving to the side of the road. Also I remember the officer verbally told me I was driving 74~75 when passing but he wrote 78 on the... View More

2 violations, 1 point count for each conviction, total 2. Fighting speeding, not good, passing, possible. Background check, minimal effect, unless you have an FTA and a warrant is issued. This case arises under traffic ticket law. You need to discuss with an attorney in Oregon that specializes in... View More

An indictment is issued on charges that are usually more serious than a simple infraction. It means that he is probably being charged with a misdemeanor or misdemeanors. This case arises under traffic ticket law. You need to discuss with an attorney in your jurisdiction that specializes in this... View More

Sorry to hear about your situation. Usually the Court makes an exception to the tinted window law if you have a visual impairment that requires additional tinting. But if you have a legitimate medical need you may be able to convince the court to dismiss. An alternative is to plead guilty and pay... View More

Courts process a lot of traffic tickets, but no need to treat defendants gruffly. Obviously, you have stepped afoul of the Court rules regarding processing your ticket. Today most traffic tickets carry with them penalty assessments and court fees so a fine of $100 can easily reach $500. Courts... View More

I am so sorry to hear that you were involved in an automobile accident. You mentioned, "we", so I hope everyone is alright. It is even worse when you get blamed and cited for an accident. First, I can understand the frustration. You must set aside your feeling of being "wronged"... View More

If the prosecution wants to proceed on this, then you will not get it dismissed on that basis only. The prosecution must prove each and every element of its case against you, which essentially is that you were operating a vehicle over the speed limit within its jurisdiction-----if the law... Since you were hit by a cop in the state of Oregon, tort claim notice will need to be received by the employer and/or city/county/state attorney of the cop who hit you within 180 days. The hearing for the ticket will be important, as the judge will be determining weather or not you were at fault... View More
This fine is devastating and seems way out of line with the infraction. There was no one at the intersection (except the officer), he was driving under the speed limit, and he made a conscious decision when he saw the stop sign that it would be safer to drive through it than to slam on the breaks.... That fine is the maximum fine for a class A misdemeanor.
Typically, that is not the fine that is imposed (at least I have never seen it/heard about it being imposed).
Your son would be wise to get an attorney, prior to his court date. In my opinion, it is usually best to find an... View More

First, the collection agency is collecting a debt. They are not the Department of Motor Vehicles (DMV) and have no power to suspend your driving privilege. Second, you mentioned "grace" period. Did your insurance company deny coverage for this accident even though you just bought the car?... View More

you asked this twice. Check the answer I and others gave. This looks like an identical post.
I recently got a dui, driving home at 1am alone, while under the influence of marijuana.
I wasnt parting all night, I was on campus working all that night.
this is my first offense.

You need to speak with a DUII attorney as soon as possible. It sounds like (from your question) that you are thinking about doing this alone. You should re-think that, even if you are eligible for diversion.
Getting into diversion is not the hard part of dealing with a first time DUII... View More

This is an incredibly frustrating situation. Unfortunately, bad advice is not a defense. However it can be incredibly mitigating.
The notice issue could possibly be a defense, but, most of the time when someone is convicted of a DUII they sign a suspension notice right there in court.
I was involved in accident in Oregon . The officer wrote me a ticket for wreck less driving warning which Idint know can it be challenged ? Now I am looking to work for different company & it's showing up on my record I am holding a Cdl license . & new company won't hire me.
