You should pursue the case and obtain an attorney if the other driver was ticketed if your daughter sustained injuries. It might be possible to negotiate for a higher figure. A place to start could be to double-check the references (auto industry data) used by the PD adjustor in reaching the figure they quoted.

If you have liability only insurance, then you are likely not covered for any damage or harm to you or the passengers of your vehicle. You should review your policy to determine the coverages.

Texas law requires that any rejection of Uninsured Motorist (UM) coverage be in writing. Have your agent show you the writing where it was waived/rejected.

Q: What will happen to my claim if the excluded driver on my policy was driving. Other car was at fault.

None of my drivers information was taken. He shouldnt even be excluded, he was only listed because he owned the second vehicle on policy. I removed vehicle back in November 2017 and he should have been taken off with that. How would I file this claim?

you file a claim for the damage to your car with the at fault driver's policy. Don't get into all the back and forth about who was and wasn't driving.

The driver has a claim for their injuries which they need to see a member of the Texas Trial Lawyers Assn for--they give free consults.
