So sorry, your question as posted did not include a number for a patent or a published application.

You may want to re-post. Your question is not really one for Business Law or Product Liability (litigation re hurting people with your product). Your initial question is a pure patent...

Q: Other driver did hit and run damage to my vehicle and had no insurance, can I file a small claims lawsuit for damages?

A few weeks back there was an incident that happened where my car was hit on the passenger door side. The driver of the other vehicle stayed for about 10 minutes but when the police was called she drove away (almost running me over). I obtained the police report and she was found at fault and given... View More

See if you can obtain the insurance information for the other party who was at fault. They should be able to reimburse you for your loss. If not, filing in small claims would be an option.

Q: I agreed to watch a puppy, someone stole it , security cameras recorded it. Is it my fault if we didn't have a contract?

My camera recorded someone stealing the puppy I was watching from my closed yard. The owners story made no sense to begin with, pay $1500 for a puppy then find a foster for it a few days right after you receive it, no contract, didn't discuss liabilities. The puppy wasn't shipped in the... View More

Q: My upstairs (condo) neighbor had Sears (insured) install a washer/dryer. It flooded and damaged my unit. Who's liable?

Apparently there was an issue with the machine or installation, so upon use, it flooded water into the floor (my ceiling). When a California homeowner hires a contractor to work on a home, the contractor is ordinarily considered an independent contractor. This legal status means the homeowner generally will not be liable for accidents or injury to others, unless the homeowner directly contributed to the incident. If... View More

Q: My car was wrecked by the dealership after 1 week of purchase, is there anything I can do for them to refund me?

Contact a lemon law attorney, but I don't believe that being in an accident makes a car a "lemon". That usually refers to a defect that can't be repaired after more than one attempt.

Sounds like a recall notice. If so, take it back to the dealership and tell them you want it fixed under the recall.

Unless there were some factors that put the mobile home park on notice that cars were likely to plow through the fence (like prior similar incidents), I don't see why the park would be liable. Your homeowner's insurance will pay to repair/replace your mobile home. You might also file a... View More

If I understand you correctly, you have had no treatment for the receding gums. Without treatment, you won't establish any damages. Also, a "podiatrist" treats feet and ankles, not sure why one is commenting on receding gums. Further, there is no evidence that the mouthwash caused... View More

Suing will be costly and you have no damages other than a third party being an idiot. If they had the title--which I assume they did--check to make sure he endorsed it to them. If so you are the titled owner. Park in visible areas.Tell him his complaint is with the tow yard, not you.

Law students are not authorized to practice law. Neither are paralegals. Only attorneys are authorized to practice law. If you don't need full representation, consider hiring an attorney on a limited scope basis. See, for example: http://limitedscopecounsel.com/
