I recommend hiring a competent attorney to file an Action in Chancery for Rescission. You will not make any money but you should mitigate your losses.

Actually had possession of vehicle. I had told them and person filling out loan papers I did not have income to make payments. Can I file suit against family member to have them pay this?

It sounds like you are being sued on the Note you signed. An attorney can sue the other party for contribution, but collection is another matter. Bankruptcy or a Settlement may be options. If a Judgment goes down, protect your assets and file a Notice of Exempt Property.

Your contract is apparently with SW Transport. Read the contract as it will have some disclaimers of liability. But it may give SW as your agent the power to hire another party to perform the contractual duty. If under $ 25K you might sue both carriers in Sessions Court and let them blame each... Read more »

That would probably be a conversion cause of action against the dealer. There may be criminal liability, but you would have to make the allegation to the police and you would need information about who to accuse. Hire a competent attorney now and file suit.

Depending on the value of the jack, it could be a misdemeanor or a felony charge for Theft Of Property. Hire a competent attorney to represent you. Restitution may need to be made despite the recovery. You want to get it Diverted, Dismissed and Expunged. Otherwise it will affect you for life.

It is possible to find judgments and court approved settlements. You would need to know where the case was filed- State Court or Federal. And then in what County or District. For Federal Court you can check online on the Pacer system.

Probably not a problem. Journal entry is not required and the Seal can be affixed later, but needs to be there prior to the instrument being used or relied upon. Notaries should sign their full names, but often do not.

You may wish to file an Action To Recover Personal Property in General Sessions Court. If not, you might as well abandon the items, because going there might be charged as Trespass. She might even charge you with Theft of Property if you take something.

Hopefully you have a Bill of Sale for needed information. You can sue the Seller for Fraud and Breach of Contract. But you will need some proof of the Salvage Title non-disclosure. If they knew or should have known, that's one issue. Check the VIN number and get a carfax report. They could have. Your better claim may be through the State AG's office of Consumer Affairs.
