Q: Can a fashion designer not hire you as a model for a show if you’re diabetic with an insulin pump?

I was first offered the opportunity but then he had second thoughts because I wear an insulin pump. He’s afraid it may show or something would happen.

Both of his concerns can be overcome. I'm thinking ADA, but I don't think a lawsuit is in your interest. Other attorneys may disagree.

Q: Do I need to form a PLLC vs an LLC if I am Physical Therapist looking to start my own practice in NY?

I formed an LLC already. Unaware after reading some websites that licensed professionals are supposed to form a PLLC but I wanted to confirm if that is true.

My understanding is that the PLLC is required, or at least, preferred.

Q: Is it illegal to threaten a defamation or “slander” lawsuit against someone who is spreading rumors to get me fired?

The doctored story is 100% false with proof. She is going around saying I still money from a previous employer but there is proof I didn’t on cameras and I’m in nursing school and really don’t want people to think I’m stealing money.

If you are being defamed, you are permitted to demand it stop, and to advise that a lawsuit will be filed if it does not.

Q: How long after retainer is paid should it take to hear back from the lawyer ?

It’s been 3 weeks . I sent some documentation with the retainer that had to be reviewed . He was easily reached prior to payment .

how long it usually takes to have initial consult after payment ? I’m not sure if this is normal

It doesn't sound right. There is usually a free consultation prior to retaining the attorney.

Then, three weeks is far too long.

Consider getting a full refund and retain alternate counsel.

Q: I am a defendant in a thirteen-year-old civil case. Depositions were finally completed two years ago, and still nothing.

It stems from a criminal assault charge, all charges being dismissed and sealed, and then I won a civil case on false arrest charges. But the civil case against me still goes on. Can some one give a good explanation why? Thank you very much.
