What you are going through is not uncommon. I now add to agreements a date certain, where possible. Your attorney can threaten to pull the settlement or make a motion to enforce.

California Code of Civil Procedure § 340.5:

“ three years after the date of injury or one year after the plaintiff discovers, or through the use of reasonable diligence should have discovered, the injury, whichever occurs first.”

You may have a lawsuit against the hospital. Morax are needed. Certainly the hospital in certain circumstances has the duty to prevent you from falls. Consult with experienced malpractice attorneys in the state where this occurred.

If a person was diagnosed as needing and referred to hospice and the medical person so referring knew it was not true, this could be fraud.

Service of process is not dependent on someone accepting service. If you process server presents the document to the person they are considered served.

Yes you may have a case. Medical malpractice means that a doctor violated the standard of care. A bad outcome is not enough. Another doctor would be needed to evaluate what the doctors did.
