The law in New Jersey recently changed regarding the emancipation of children. Under certain conditions, emancipation occurs automatically at the age of 19. Although your daughter is only 18, you may still be able to file a motion for emancipation if certain conditions apply. You should contact... View More

If you have joint custody in the form of a court order there should already be a parenting agreement in place. Pick-ups and drop-off schedules are typically included in these agreements. If your agreement doesn't define the pick-up and drop-off schedule you should file a motion with the... View More

You would have to adduce facts that would convince the court that your current parenting arrangement is not in the best interest of your daughter. Doing so will likely be difficult since the court will need to evaluate your case based on several factors. For example, the age of your daughter, the... View More

Assuming the TRO is limited to the assault, a non-consensual posting of sexually explicit photographs is a criminal offense at both the state and federal levels. You should contact a New Jersey Family Law attorney to get this resolved.

Did she die intestate or with a will? You're going to need a lawyer to intervene on your behalf or reopen the estate if it's been closed. But you need to decide quickly.

If you kept your married name at the time of divorce, then the only other method is an application to the court for a legal name change. But only you can do that; not your ex. If you haven't already, call the school to see if it's a clerical error. If you still suspect shenanigans,... View More

Violating the parenting plan, especially for a non-exigent matter, is never a good idea. Unless your wedding is right around the corner you can try consulting an attorney.

Seeing "numerous" females is insufficient information. The answer depends on several circumstances like what your son is (or isn't) exposed to during his overnights with dad, what sleeping arrangements exist, etc. You can determine your options by consulting a family law attorney.

Q: i got my now ex-fiance a dog for his bday. On the dog's adoption, it has my name. Do i have any rights to see him?

Although he was a gift we always said he was our dog. I was always mom and he was always dad. We both took care of him but now after the break up he doesn't let me see him. You really need to think hard about how much you want to see the dog. Since you were never married, the dog is not marital property and therefore not something you should pursue. Realize that you have no "rights" to the dog (even if s/he has your name). And, if it's not too... View More

If there's a court order in place (sounds like there is) and your ex- is violating the parenting schedule, you have several options. There's a strong presumption in favor of the validity of a marriage in New Jersey. So I agree with Attorney Boyer. If you really want to get out of your marriage then filing for divorce is what you should do. In New Jersey, people are encouraged to investigate matters and disclose premarital... View More
