Q: My mom signature was forged 15 years ago on a quit claim deed document. Is there anything we can legally do now?

My mom and dad got divorced in 2005 and decided the house would go to me or my dad had to sell it and split the profits. My dad lied and said he sold it to my sister, but what really happened was my sister forged my moms name and also notarized the quit claim deed in 2007 saying my mom was giving... View More

Most fraud has a statute of limitations date of four years from the date of discovery. It sounds like you are well past the statute of limitations to contest the fraudulent deed.

Call Ohio adult protective services ASAP: https://aps.jfs.ohio.gov/

If she doesn't actually live there, then change the locks and lock her out. She is not a tenant and not subject to Ohio tenant protections. Call the police as well and report her for trespassing.

You have a low likelihood of being deemed to have admitted fault by giving a refund. Businesses give refunds for things for unhappy customers all the time.

If she's physically attacked you, call the police and have her removed and get a restraining order.

If that doesn't work, you will need to evict her and go through your municipality's eviction process.

You are not personally responsible for the loan, but there is likely a lien on the house as a result of the loan allowing the lender to foreclose on the property if the loan is not satisfied.

It is illegal to smoke marijuana in Ohio. This is true even if you have a medical card. Your employment is also not protected from the use of marijuana even if you have a medical card. Marijuana in your system will likely be determined to be a contributing factor in any accident.

Q: How likely is the court going to sway in side of mom getting custody during a divorce because husband is mentally…

Emotionally abusive in front of the children? Will it matter who files first? Mom pays for all health insurance and healthcare, dad does not contribute. Mom works from home but is primary care taker of the kids.

With mom being primary caretaker and paying for most things, a likely starting point for any parenting plan will be the standard parenting time guidelines of whatever court the divorce is pending. Would need a lot more information on the emotional abuse part for anything further.

Q: Which is better for child custody case , attorney that represents you or a GAL?

I’m stuck between just paying for the GAL which will help tremendously because it’s getting the background of both parents. However, I am absolutely scared to go into court without a lawyer to back me up with dealing with my child. I’m debating on just doing both at this point.

I'd have to see what the court says about the bio parents signing away rights, but it is likely that you can switch residential custodian for school purposes by agreement with maternal aunt. I'd recommend a joint motion with a proposed agreed judgment entry making the modification.
