Q: My father recently had a stroke and I will be his primary caregiver - I am his daughter. My brother moved into my

Parents home in early March saying it would be for a couple of days - he has not left. He and I don’t get along and he pushed me the day he moved in. Can I get an emergency restraining order to have him leave so I can bring my father home? We live in Merced - California.

courts really look at the victim as the State of California.........what you want is often not important to the DA/Court.

Q: I have a past domestic violence record that was expunged. It was back in 2005. I would like to know if I can buy a gun?

I live in California. It was a misdemeanor. I was 18. I'm scared with these new gun purpose gun laws. Open carry is scary.

10-year Ban under California law from date of DV conviction. There is however a Federal lifetime ban on firearms.

that would be civil litigation, not criminal.

chances are you would only find a lawyer to do so on an hourly, not on a contingency

Q: Can a domestic violence case thats been dismissed along with dropped charges be reopen? I never went to testify.

This happen in the state of Oklahoma. I didn't go to testify and so the case was close and dismissed. The case was close in

November 5,2020. I didn't want to press any charges at the time.

you need to ask for a consultation with an Oklahoma Lawyer.

if case is dismissed it is over..............but it just may not have been prosecuted for some reason

it is not up to a victim to determine if charges are to be dropped.
