Q: I was charged with theft of Identity but there is nothing linking me to it but the victims word.

The only thing that links me to the charges is the victims word and that my phone was used in the situation.

Your phone being used could make a prima facie that you were involved. You need to hire a competent criminal defense attorney to represent you.

It’s impossible to say whether you could’ve beaten the charges without a thorough review of the file. However, now that you’ve pled guilty, it’s unlikely that the cour will set aside that plea.

Probably. Get a note from the ER, the results from your test and ask the judge to set aside the fta and jail time.

Q: Live in Kentucky on probation in Ohio who has the authority to let me go back to work issuing a travel permit?

Kentucky probation and parole is blaming Ohio but there is nothing in my conditions of supervision from Ohio State's that I cannot return to my full-time work it's the only means I have paying fines and restitution

Theft by Deception in kentucky is a class D felony which carries 1 to 5 years. Does the "false Impression" add more to a sentence and if so, how much

No. It is simply one type of Theft By Deception. The penalty remains the same.

Reasonable I’d determined the the facts and circumstances surrounding the issue. It could be 30, 60, even 90 days. Bottom line, if you refund the money, they will likely dismiss the charge.

Q: What are limitations on a criminal case subpoena that I have been served in order to testify as a witness?

My court date has been rescheduled 2 time prior to being subpoenaed. It was just rescheduled again tbd. This is stemming from a hunting guide taking me onto land I did not have a permit to hunt on 2 years ago in Inez, KY. I live in Crestwood, KY.

If they haven’t served you by sheriff or other adult person, you haven’t been properly served and the subpoena is unenforceable.

Q: Ky - will I go back to jail today?

Ky - was arrested for failure to appear and judge released me knowing I have a probation revocation hearing pending for absconding in a seperate case. The judge told me to report to probation upon releasing me. Will I go to jail today for reporting even tho the judge already knew about it?

Q: What can you do if your paid attorney won’t come see you in jail or let you know anything or answer.

Won’t answer any of the communication from inmates family or anything. Won’t even answer how much more he want paid or anything. He ended up not doing his job and it cost the inmate getting violated 18 more months on charges that were dismissed. What can we do?

Call the lawyer and ask for an appointment to meet to discuss the matter. Be sure the inmate has given the lawyer permission to speak with you or he won’t be able to discuss the case with you.

It’s a motion for default judgment against you with a military certificate that you were not in the active military while the case was pending.

If the attack happened in Kentucky, then yes, you would have to file the charges in Kentucky.

No. They cannot increase the sentence if he goes back to court.

You need to go see the Conmonwealth Attorney for the county where this occurred, to see about prosecuting him. If you want to file a civil suit, you will need a parent or next friend to bring it on your behalf bc you are a minor. You may want to consult a civil lawyer in this aspect to help you.

Bottom line, visiting an inmate is a privilege, not a right, and corrections has pretty wide latitude in enforcing their rules and regs. Nothing you can do about it until a divorce is filed bc the EPO is against you, not her.
