Search warrants are by definition signed by a judge, ex parte -- meaning with only the unchallenged claims of a police officer. The person targeted has no way to challenge whether a search warrant was really warranted until after it is executed by police. Normally, the legal challenge to a search... View More

Q: What can I do in a situation where one is falsely accused?

Hello,

I am asking on behalf of a relative who, due to a misunderstanding, was falsely charged with an altercation against law enforcement. I understand that the subject itself is touchy, but I am at a loss as to what they can do. To sum up the event:

Please, for your own sake, do not post any more information about this case online. It only takes one search for the police to determine who you are and link anything you say online to your case. Valid or not, you will need an attorney to review the facts and defend you.

The best way to get a good answer to those question would be to ask the right person with the P.O.S.T. Board (police licensing agency in Minnesota), and the appropriate military branch (probably with the J.A.G. office, not a recruiter, for example).

I do not know the answer to the specific...
