It depends on who you called. Is there a current income withholding order in place? I would reach out to DFS to see if they can help. Otherwise, I'd recommend seeking legal counsel from a family law attorney.

Q: What happens if the child is not with the parent getting child support.

And they receive the money but are told by the other person tell them they cannot use it or they will get in trouble. And they want to use it to fix the room for said child so they can get the child back.

Are they for the same child? Sometimes if you check is not enough to cover the payment owed, the income withholding order will split up the percentage so that you are left with a sufficient amount of income.

To alter support and/or custody, a party needs to submit a modification. So if she has not sought to modify the decree, then you remain under the obligation (or lack thereof) of the original decree.

You are correct. If you can donstrate that you have been making direct support payments, then you have a good argument for receiving credit for support paid. If you do not have proof and she is willing to perjure herself under oath, then the judge will make the determination.

If he has the ability to work he will be attributed at least full time minimum wage as his income. If he has a history of positions or a career he left that paid more and has no legitimate reason for his unemployment status the court may attribute a higher income to him. No is the short answer. The long answer is that your husband can seek to do a step parent adoption of your daughter that would make him the legal father and terminate the parental rights of the biological father. Realistically you will need an attorney to help with this process.

Yes, it's possible. Support can be awarded until a child is 21. A court could also order you to contribute to the cost of college.

Child support can be changed any time there is a change in circumstances that effects overnights, health insurance, income of the parties, and other factors resulting in at least a 20% change or a change in who pays.
