Q: My friend has a restraining order brought against her by her husband and she wants to get it lifted.

Can she just file the paperwork herself after getting the papers looked at by an attorney, or should she try to get representation? She is completely financially dependent on her husband so she doesn’t have much money at her disposal.

the court does not care that you worked it out though that is positive.

the victim is the People of the State of California so it is the DA that represents them and must be convinced to dismiss or reduce charges.

any time there is an order you would have to make a motion to put the matter on the calendar and hopefully come in with an attorney to argue your position.

you don't want to dismiss the RO and get arrested and then have to argue after the fact.

if you are a victim and call the police and they arrest your husband the crime is against the People of The State of California........it is in the hands of the DA..........you may want to talk to your Husbands lawyer or hire your own

She can always make the request if SHE wants to remove it

I I tell my clients to wait to see if she will forget about you and not renew it at the end of three years if you are still on probation. Talk with a lawyer in the county where the order is to get specific advice.

Q: If an alimony claim was filed in in July 2020 also a restraining order for violence, then the client used his one delay

Due to lack of a lawyer, than the lawyer pushed the hearing back 3 months, from September to December, then the lawyer dropped the client due to lack of payments, the client gets a new lawyer 3 weeks before the alimony hearing, can the case be pushed back again

but yes it is at the discretion of the judge...and with Covid, everything is up in the air.

There is a restraining order currently that states no contact whatsoever, and a pending criminal order from the DA waiting to be served upon booking.
