Q: Can my wife get an early installment on her SSI so we don't have to take bankruptcy.

She wants to use part of her SSI lump sum amount to get us out of debt with our creditors as the amount owed keeps going up each month. Can a judge order Social Security to pay the installment so we can get out of debt. We want to pay what we owe instead of taking bankruptcy. If we can't... View More

You may be able to protect the SSI lump sum payment and file bankruptcy to discharge your debts. You could also choose to use your wife's SSI lump sum payment to attempt to settle your debts without the necessity of a court order. If I were eligible to file bankruptcy and protect my SSI... It depends on why they have terminated your benefits. Is it due to an overpayment or your ability to work has changed?

They don't deny you for not following treatment. They deny you for not having a record saying what you have.

See what letter you can get from the ARNP. Ideally, if they believe in your case they will write why you cannot work at any job on a sustained basis and ask that social...

Q: I'm 56, disabled and on full disability, receiving S.S.I. If I was to move to Australia, would I still receive my S.S.?

I also have medicare and a secondary insurance which pays for my medical supplies. If I move to Australia, will I loose my coverage and medical supplies?

The big question is out in Oz will they accept medicare as payment? You won't get SSI, that's for sure. Generally you can move and get your social security--many retired to Poland for example and collected. But SSI doesn't cross borders

I'm assuming you don't qualify for Social Security Disability under your own earnings record. If you file for divorce but are in the household you may have issues. If the real issue is medical care, you may be able to apply for adult basic. Suggest you speak with a local disability... View More

Son's guardian should check with social security;. If father passed, note there may be life insurance policies that benefit the son that people have forgotten about.

You do not get nearly the amount of money the person paying taxes into the system would have received. I have seen checks as low as $50 and as high as $700. It really depends on how much the wage earner earned during his lifetime and how many recipients are collecting on the benefits. There... View More

You have Internet access; presumably you have a telephone. There is no reason on earth you need more than three months to find an attorney to take your case (if it is a valid case). So in my opinion the ALJ will not grant a further continuance.

I think you may be confusing Medicare and Medicaid. Your father has Medicare Part A and B. Unfortunately, Medicare will only pay a portion of a nursing home bill for 100 days - max. Medicaid will pay for the nursing home bill if your father qualifies. If he does not qualify, there are strategies... View More

That depends upon the facts, and all we know is only what you have written, which is not enough to conclude that something even can be done. When you have a legal problem, you need to speak with an attorney.
