No, but you may run into problems of proving what happened. File a police report for starters. If you have collision let your company cover it and go after the dog owner.

Q: Do you have to have your car repaired with the insurance claim money or can you pocket the money instead?

A woman backed into my daughter's parked car. When her insurance pays on the claim, do we have to fix the damage with that money, or can we pocket the money instead? The car is paid off and the damage is minor to the rear bumper.

You can pocket it and drive the unrepaired car.

Q: actually i wasnt served for the actual judgement. the accident was 4 yrs ago n i had no knowledge of court action

i wasnt served until the court had already made the ruling and they served me on the actual wage garnishment....my employeer never even notified me. i was suprised when my check was nearly half

If you weren’t ever served, you need to see a local attorney immediately bc the garnishment May be improper or illegal.

Q: i am being garnished from an accident 4 years ago and i cant pay my bills or feex my kid. what can i do

i tried for low income assistance even but my gross is what they count. the garnishment was set at 20000 dollars but i didnt even know about it til i was being garnished

You may try to negotiate its the garnishee. At some point, you had to have been served with the complaint o thy couldn’t have gotten a judgment against you, which is a prerequisite for a garnishment. No. You are entitled to payment for the damages to your vehicle but if there were no injuries, there is no claim. You may not recover for your wife’s anxiety because you were not there.

Contact the investigating officer, explain your situation, and see if he will release it. He may since you are innocent and pictures of the damage will suffice as evidence. If he won’t release it, hire a lawyer to get it back for you. The judge can order it released to you.

Most states have things an attorney can do to get treatment. Problem now is showing your treatment you lied about is related. Sit down with your attorney, review what can be done.

Most police allow you to file a police report on your own. They won't respond--it's just your report but that gets it on the record.

Notify your insurance agent, obtain a copy of the police report and take photos of the damage to your vehicle. Your insurance company will help you the process.
