Insurance under parents

Was there a crash? If not no problem. Even if there was, I don't see a problem under most scenarios. Rates only go up if the driver is at fault in causing the collision, if there was one. The question of fault has nothing to do with the license.
My daughter was hit by a driver who ran a red light. The other driver was ticketed. His insurance company denied our claim without even having a copy of police report. They have also been very difficult to contact. I read that Texas doesn’t allow bad faith lawsuits unless it is between the... View More

You should pursue the case and obtain an attorney if the other driver was ticketed if your daughter sustained injuries. There may be other options considering the facts of the accident and whether you also have coverages that can apply. Of course there are time limitations on a lot of claims.... View More

Based on the facts at hand, it isn't mentioned what their offer is. If you consult with a Texas injury attorney for their opinion on the insurance company's offer, they are going to want to know more about the medicals. I was rear ended and went through the liable parties insurance. After a few weeks, he was found liable and I obtained the incident report which corroborates my story as well as supports my statement that he was, "inattentive." I was texted by the liable party stating that he has closed... View More

You can still submit your damages to his or her insurance company for direct payment. There may be supplemental repairs to your vehicle so it is best to let the insurance company deal with it. Sometimes, these repairs are really costly and some damages are not seen until they begin repairing it.... View More

It might be possible to negotiate for a higher figure. A place to start could be to double-check the references (auto industry data) used by the PD adjustor in reaching the figure they quoted.

Then, the underwriter declined, because Allstate does not have a million as liability in the landlord policy. The underwrite told the agent, but agent ignored it and did not inform me at all while I was overseas, the agent knew I was overseas. So when I found out on 9/5, that I do not have a... View More

I do not practice in Texas but your question remains open for three weeks. An experienced attorney familiar with insurance law (including underwriting issues) should be able to provide guidance.

If you have liability only insurance, then you are likely not covered for any damage or harm to you or the passengers of your vehicle. You should review your policy to determine the coverages.

Texas law requires that any rejection of Uninsured Motorist (UM) coverage be in writing. Have your agent show you the writing where it was waived/rejected.
None of my drivers information was taken. He shouldnt even be excluded, he was only listed because he owned the second vehicle on policy. I removed vehicle back in November 2017 and he should have been taken off with that. How would I file this claim?
answered on Feb 26, 2018
you file a claim for the damage to your car with the at fault driver's policy. Don't get into all the back and forth about who was and wasn't driving.
The driver has a claim for their injuries which they need to see a member of the Texas Trial Lawyers Assn for--they give free consults.
A warrant was issued in 2002 for no insurance on my vehicle and they are telling me there is still a warrant out for me.

The statute of limitations is tolled once the charging instrument is filed with the court. The statute is 2 years for misdemeanor cases in Texas, but once the case is filed with the Court, the statute of limitations no longer is an issue. For a 2002 case, however, they may be other issues you can... View More

Understand the playing field. It's not the Kelly blue book but the NADA blue book that matters (or the McClean Hunter Market report called the red book). Value is what sons car would be worth the minute before the crash. Look on cars.com and you'll get a better idea--use a 450 mile radius... View More
