Q: Hi I hit a car from behind only minor damage to the bumper on his side neither of us has insurance no police report

Do i have to pay for his damages? What happens if I don't?

In Washington, the statutory default is the rear-ender is responsible, so you may get sued if you do not.

Yes, if the police believe that you did.

You should talk to a lawyer immediately, and do not answer any questions from police until you have spoken to a lawyer. If you don't contact one on your own, let the police know that you want to talk to a lawyer before you answer any questions at all.

Did she let the insurance lapse? If you weren't on the registration don't know how they could get to you.

Q: What are my options for after getting rear ended at full speed by an uninsured motorist? Poperty damage is over $10,000

I got rear ended at full speed at a red traffic light and am suffering from injuries from the accident. I am not completely sure whether or not the motorist is insured or not.

If your daughter was injured you should seek the advice of local attorney. That would mean to retrieve the police report of the incident. The fact that your ex didn't inform you does not make out a case of any kind.

Q: I was in an accident last week and i have no insurance but the driver at fault does do they still cover my damages?

The insurance company is telling me that since I had no insurance and had the car in my name 2 months prior to the accident there is nothing they can do since i had not put insurance on my vehicle before the accident. Is there anything i can do?

Yes, if the other driver was at fault then their insurance company is responsible for compensating you.

From a practical standpoint, demands are usually directed up to the policy limits. At times, a demand can be made for more but it may be impractical to do so. Sit down with your attorney and another attorney in your area to discuss the best and most sensible way to pursue your case.

Assuming the road wasn't posted no turns and there wasn't a divider it would seem the person could stop to turn.

Your problem is that if you pay any money you want to make sure you get a release of all claims.

Look at your agreement. If it says residents can only park registered vehicles that means fully registered. It's a little persnickety of them but they can tow if they want.

Q: I am searching for US case law to establish myself as an owner operator ( independent trucker ) for a lawsuit

I was in an accident. The other driver was at fault. The company I was leased to filed a claim against my loss thereby screwing up my case. The insurance company is awaiting proof of ownership even though I sent them my contract along with my claim

There are several claims you may have. For what was in the truck, for damage to the truck or trailor, for your damage (injury/medical bills/lost wages).

A lot depends on Washington law but generally, your insurance would be secondary to hers. Do you have the car listed on your policy? If not list it as a covered vehicle. In most states the person has to show you were at fault to hold you (as oppsed to your insurance) personally liable.

Only if you had an agreement with them. Otheriwise, presumably you received mileage which in part would compensate you for insurance which is what should cover your damage. If you chose to not get insurance, your baby.

Your roommate is fine, nothing is going to happen to him. Make sure you (both) transfer the title when the sale is done, it can be a crime if you don't. Pay the damage and get a full release of all claims. You could foul things up by not having insurance or a license in which case it's unlikely--but possible--your car could be impounded if you insist on driving it.

First get court records, contact dmv see what you can do.

Second if that doesn't work contact your state legislators.

If he was hurt in the crash, contact a member of the State of Washington Trial Lawyers Assn--they give free consults.

The cost to get her out (I assume you mean out of jail) is the bail amount. Check the website of the jail she is being held in and you should find the bail as it is set. You can only have a bill of sale if you had in fact sold it to her on that date and that can be proven. Fooling around with dates makes you look shifty --or worse, and can cause other issues of a felony nature.

They should if you are the owner, but at this point get the car out of there--or if you have collision your car insurance will pay the tow, but tow rates go at a heavy rate regardless of whether you have an argument to make.
