I received a citation today in el mirage. The officer did not fill in the date of the incident. The space is blank. The only date on the citation is the court date. Can this be dismissed?

Sometimes facial errors are enough to have a ticket thrown out; the clerks may not be about to enter the ticket information into the court system without a date. BUT, the cop can always fill it in on his copy and file it that way. The cop's copy is the ticket, all you have is a carbon copy.

You never need to give a statement to police. Politely decline. The police are only doing their job; they want rapists off the streets and don't want anybody else hurt. If the police continue then call a lawyer. Best of luck.

The cops are certainly allowed to ask the questions. The only thing you control is if you answer and how you answer. You never have to answer such a question, but be prepared for the consequences. You should politely decline to answer the question until you speak with your lawyer.
