Q: Under PC 3453 what does "The person shall not be in the presence of a firearm or ammunition, ..." mean?

This is a rule under post release community supervision. My son will be release from CDCR soon.

The person, and his or her residence and possessions, shall be subject to search at any time of the day or night, with or without a warrant, by an agent of the supervising county agency or by a peace officer.

don't sign anything without a lawyer's review and ok.

there is often a difference in the evidence presented by a defendant and the DA.

contact a lawyer or request that the court appoint a public defender to represent you and review all the facts.

IF your facts are the total facts, I hope you called the police and they arrested him for Assault with a Deadly Weapon.

i assume you have indexing info on the party at fault.

if you were not injured, send a demand letter and sue in small claims court for up to $10k

Something is missing if your lawyer thought the case had value..........

Either s/he is having issues with you as a client, or liability or damages are not as sound as you think.

Call any of the lawyers herein and see if they would look into it, and would contact your initial lawyer...

Q: How do I get my car out of evidence?

Car was taken into evidence when I was arrested, case went to trial and on second day the judge dismissed case. I've called the police department several times and they said the D.A. hasn't released it yet, the case was dismissed 4 months ago.

THE FIRST THING I WOULD DO IS CONTACT THE LAWYER THAT REPRESENTED YOU ON YOUR CASE TO TRY TO GET A COURT ORDER...IF CONTACT WITH THE POLICE DEPT DOES NOT WORK.

I think it would be stupid to ask a 16 yr old for a kiss when you are 26.

That could only have a bad ending for you...........if you were my son, I would say...don't "hang" with girls under 18

The best advice I can give is to USE A PUBLIC DEFENDER.

The court will appoint a lawyer at the Arraignment.

Public Defenders know that particular courtroom better than any private lawyer.

They deal with that Judge every day.......unlike a private lawyer that may only appear...

Q: Will the cops show up to my first day on the job?

So my first day of work is tomorrow. I'll be merchandising for a few grocery stores. But I have yet to clear a few warrants in my name. I work for a third party and our stores change every day. Do you think they can show up? Thank you for your help!

A lot more info is needed.

However, I don't understand why they would just show up.

Of course, if you have warrants and they are serious, the police could contact you at any time.

Q: Do I have to handle a fta warrant before i do SATOP classes to get my license back

I live in California and cant go to Missouri to handle the warrant, I am trying to get my license here but have to do a SATOP equivalency class to get the hold off my license. Do I have to handle the warrant and case first? Can I go ahead and do the classes and get my license back

if there is a warrant that must be cleared up.

is the warrant related to a driving issue?

you can retain a lawyer in Missouri to take care of it for you in most misdemeanor cases.

however, most lawyers in California will not know the law and procedures in that state.

When you say illegal, you are talking criminal. That would require your proving criminal intent. I would want to hear the doctor's version.

HAVING A POLICE REPORT WOULD BE HELPFUL.

THERE IS NO WAY THEY COULD USE LAPSED INS AS PROBABLE CAUSE TO STOP.

IF YOU WERE IN COURT YOU EITHER RETAINER A LAWYER OR THE PUBLIC DEFENDER WAS APPOINTED. THAT IS THE PERSON WHO CAN INTELLIGENTLY ANSWER YOUR QUESTIONS.

the issues are will you win and can you find a lawyer that will gamble with you rather than asking for a retainer for hourly representation?

Q: If the police have a search warrant for an address why would they stand outside for two hours until everyone came out

The police stood outside saying they had warrant but never gave it to the ones detained or the property owner when she asked. They mailed the search warrant a 10 days after raid.
