Certainly sounds like they screwed up.

However, I think the pivotal issue will be costs.

this is not the type of case most lawyers would consider accepting on a contingency.

thus you will be paying a lawyer for his/her time...and that is costly.

because of Covid, it is the rule rather than the exception.

criminal cases take priority over Civil. In the past Civil cases had a freeze as there were not courtrooms available.

in the Indio Court for all Coachella Valley cases, we are behind 2800 cases and cases are being dismissed...

though i don't accept Federal Cases, lawyers usually go to the Clerk of the Court.

it will probably be on microfish.

initially, see if you can accomplish this on line.

unless it is a huge estate, I would guess they would only get involved on an hourly,not contingency.

initially i would think you would want to talk to a LOCAL Personal Injury Lawyer.

a far as suing CHP, that is always an uphill battle.

They may still be able to file and you can contact the local DA's office.

Make an appt with a local lawyer..........maybe someone with Probate experience.

Before the appt type up a detailed summary of the facts.

Lawyers would handle a case like this on an hourly, not contingency...in all likelihood.......so show you are organized.

You want to have a medical doctor validate there is malpractice.........and

most of the lawyers I know will not take a case worth at least $1M......

a lawyer would need to know the circumstances to tell you what might happen.

the sentence could be different in different courtrooms; different DA and different courthouses.

of course if you had a record or prior it would be more serious.

if there is an active case open, talk to the DA witness assistance people.

you really should try to have a lawyer assist you.

if you can't afford one, maybe legal aid will be able to do so!

I still don't understand the facts.

however, it is no different from being in a minor fender bender. The car still works and is driveable but there is property damage.........etc

Why not let them do the work rather than it being on your dime?
